[HISTORY: Adopted by the Mayor and Council of the Borough of Clementon 8-17-1972 by Ord. No. 72-24. Amendments noted where applicable.]
For the purpose of this chapter, the terms used herein are defined as follows:
ABANDONMENT OF CART
The location of a shopping cart upon lands and/or premises of any person or corporation other than the person or corporation having legal control of the shopping cart in question.
SHOPPING CART
A cart commonly provided by retail stores and supermarkets which is utilized by their patrons.

The Department of Public Safety or Code Enforcement is hereby authorized to seize and take into custody any abandoned shopping cart which may be found in the Borough of Clementon.

The Department of Public Safety or Code Enforcement is hereby authorized to store any cart and charge reasonable storage fees therefor to the person or business entity having legal control thereof.

The Department of Public Safety or Code Enforcement is directed to mail to the person or business entity having legal control of any such cart, if same can be ascertained, a notice advising said person or business entity that they have a period of 10 days from the date of mailing such notice to reacquire any such cart after payment of fees.
A charge of $10 shall be assessed against any person having legal control over any such cart, their agent, servant or employee who seeks to reacquire said cart, which charge shall be paid to the Borough of Clementon to defray the expenses of recovery and administration of this chapter.

The Department of Public Safety or Code Enforcement is hereby authorized to sell any and all shopping carts remaining in its possession beyond the ten-day notice period aforementioned, and should no buyers develop at said sale, said Department of Public Safety or Code Enforcement is authorized to dispose of said shopping carts in any other reasonable manner. Any and all sums recovered through the sale of carts as aforesaid shall be paid over to the Borough of Clementon.
