The following terms when used in this chapter shall be defined as follows:
LANDSCAPING WORK
Any work performed by a landscaper as defined in § 148-2 of this Code, and does not include landscaping work performed by residential property owners on their residential property or by the legal occupants of residential property.
PERSON
Any individual, corporation, sole proprietorship, partnership, limited liability company, or any other legal entity, association, or group of entities or individuals owning, occupying, or operating property located in the Borough of Norwood.
PROPERTY
Real and/or personal property located in the Borough of Norwood.
RESIDENTIAL PROPERTY
Any lot or parcel of real property that is improved with a one- or two-family residential dwelling.
The following specific acts or omissions, or the maintenance or allowance of any of the following conditions, are hereby declared to be or to constitute nuisances and are prohibited:
A. 
Any use of property of any kind by any person, which use is in a manner that is unnecessary and so unreasonable as to be injurious to other persons by the production or emission of odors, dust, smoke, soot, refuse matter, noise, vibration, or other similar conditions that are dangerous and/or injurious to the comfort, peace, enjoyment of property, or the health or safety of persons in the Borough.
B. 
Any use of property of any kind resulting in the unnecessary and unreasonable emission of smoke, soot, dust, gasses, or fumes in sufficient quantities to cause injury to health or to cause actual discomfort to persons in the Borough.
C. 
Any use of property of any kind maintaining or causing the maintenance or existence of any offensive matter, foul or noxious odors, soot, gasses or vapors, and all causes of disease, which are injurious to the health or cause actual discomfort to persons in the Borough.
D. 
Any use or operation, or the permitting of any person to use or operate, any tools or equipment employed in the furtherance of any landscaping work, or any construction, demolition, or similar work, at any time on Sundays or legal holidays, or at any time other than between the hours of 7:00 a.m. and 8:00 p.m. on Mondays through Fridays and between the hours of 8:00 a.m. and 7:00 p.m. on Saturdays.
E. 
The provisions of subsection D do not apply to:
(1) 
Landscaping, home repair, and maintenance operations conducted by residential property owners on their residential property, or on the residential property as to which they are the legal occupants, between the hours of 8:00 a.m. and 7:00 p.m. on Sundays and legal holidays; and
(2) 
Any otherwise prohibited work that is of urgent necessity or that is necessary to advance the interest of the public health or safety.
F. 
Any acts or omissions that cause a hazardous material incident, as defined by Chapter 139.

Any person convicted of violating the provisions of this chapter shall be subject to the penalties set forth in Chapter 174.
