As used in this chapter, the following terms shall have the meanings indicated:
TRICK OR TREAT VISITATION
The act of going door-to-door to solicit gifts of food and/or other sundries for the benefit of the person making such solicitation. This definition shall not include solicitation for a charity which has charitable nonprofit income tax exempt status from the Internal Revenue Service.
It shall be unlawful for any person over 12 years of age to appear in or upon any of the streets, highways, alleys, public parks or other places used by the public in general in the Town in any mask or disguise covering any portion of the face whereby the identity of such person is concealed, without having on his or her person written permission signed within seven days by the Chief of Police of the St. Michaels Police Department.
The Commissioners of St. Michaels may annually by resolution set the date on which children 12 years of age or younger may make trick-or-treat visitations within the Town. The hours during which such activity may take place will be from 6:00 p.m. to 8:00 p.m. local time.
It shall be unlawful for any person to appear on the streets, highways, alleys, public parks, public homes, private homes or public places in the Town to make trick-or-treat visitations, provided that this section shall not apply to children 12 years of age or younger, on the date as established for trick-or-treat visitations by The Commissioners of St. Michaels pursuant to § 185-3 of this chapter between the hours of 6:00 p.m. and 8:00 p.m.
