A. 
It shall be unlawful to use, establish, maintain, operate or let any premises entirely or partially for residential occupancy, where any rent is paid or charge is made for such use or occupancy, in the Town of Evans without first having obtained a permit therefor. Failure or refusal to procure a permit hereunder shall be deemed a violation.
B. 
Application for such permit shall be made in writing to the Building Inspector on a form provided therefor and shall contain the name of the applicant, the location of the premises and the number of dwellings and units and persons to be accommodated.
C. 
Each application shall be accompanied by a plot plan or sketch showing the size and location of the premises, all buildings and structures and showing the floor plan to scale of each dwelling unit and accommodation.
D. 
Each application shall be executed by and sworn to by the owner of the premises or such person who operates such premises if other than the owner.
E. 
The permit shall be valid for a period of two years from the date of issuance, pursuant to the fee schedule. At the time of issuance or renewal, the office of the Building Inspector shall collect a fee. Upon inspection of the premises by the office of the Building Inspector, either in accordance with this section or upon the request of the landlord or tenant, an additional fee shall be collected.

F. 
Upon application for a renewal of a permit under this article, the Building Inspector shall conduct an inspection at the premises according to this chapter and shall issue such permit only upon satisfactory compliance with the articles of this chapter.

G. 
In the event of failure to obtain a rental permit prior to renting premises within the Town of Evans and a violation notice served upon the owner of said premises and the owner of said premises is aware of rental requirements, there shall be a one-time surcharge paid to said Town of $150 in addition to any consequence of a court proceeding.

The permit fee and the inspection fee or fees, if any, shall be collected pursuant to the fee schedule adopted by the Town Board and as set forth in Chapter 106, Fees.
No permit shall be issued under any application unless all provisions of this chapter and the laws of the State of New York have been complied with.
