A.
PERSON
BOROUGH
FIRE RESCUE SERVICES ORGANIZATION
As used herein, the following terms shall have the
meaning indicated, unless a different meaning clearly appears from
the context:
A natural person or individual, partnership, corporation,
association, firm or any other legal entity.
The Borough of Kane, County of McKean, Commonwealth of Pennsylvania.
Any and all persons providing emergency rescue services in
the Borough to any resident or other person or property within the
Borough, including vehicular accidents.
B.
In this section, the singular shall include the plural,
the plural shall include the singular and each gender shall include
all other genders.
The Borough authorizes all fire rescue services
organizations to unitize such tools, equipment or materials and provide
firefighting, ambulance or other emergency rescue services as authorized
by law or the Borough, for purposes of saving lives and property within
the Borough or any other area in which the fire rescue services organizations
are authorized by the Borough to provide such materials and services
as set out herein.
A.
The Borough
authorizes any fire rescue services organization or third-party billing
service to charge and invoice in order to recover the costs of fire
rescue or other emergency services' respective services. tools, equipment
and/or materials and personnel hours from any person for whom or for
whose property such services were rendered or such tools, equipment
or material were used, and from any insurance carrier or person providing
insurance covering such persons or property within the Borough's boundaries,
including vehicular accidents.
B.
In addition
to the aforementioned, reasonable costs, the fire rescue services
organization or third-party billing service shall be authorized to
collect reasonable interest and reasonable administrative fees for
collecting the same, and any and all additional fees as may be authorized
by any other statute or law.
The reimbursement rates for the aforementioned
tools, equipment, materials, and personnel hours shall be set by the
fire rescue services organization.
The Borough shall not be responsible for any
aspect of recovery costs. The Borough shall not take any steps to
assist the Fire Department or any third-party billing service in recovery
of costs.
