[HISTORY: Adopted by the Town Board of the Town of Clay 5-1-1978 as Ch. 44, Article II, of the 1978 Code. Amendments noted where applicable.]
The Highway Superintendent and the Town Board shall approve the location and manner of construction of all poles, cross-arms, wires, equipment and underground cables hereafter erected or constructed within the boundaries and limits of any public highway by any person including any public utility or other corporation.
A. 
This chapter shall be enforced by the Highway Superintendent.
B. 
In addition to any fine or penalty that may be imposed for violation of any provision of this chapter, the Town Board after a public hearing held after personal service or service by registered mail of a notice thereof on the person charged with a violation may revoke for just cause any right, franchise, permission or consent granted pursuant to Subdivision 7 of § 64 of the Town Law. Such notice shall be served at least 10 days before the public hearing specifying the alleged violation or violations and advising the person so served of his right to appear personally with counsel and to offer proof in rebuttal or mitigation.
C. 
Failure to locate and construct poles, cross-arms, wires, equipment and underground cables in the manner approved by the Highway Superintendent and the Town Board shall be punishable as provided in § 1-18 of this Code.[1]
