The purpose of this chapter is to regulate activities and behavior on property owned by the Town of Farmington or licensed or leased to the Town or to which the Town has been granted an easement for use. The regulations will enhance the enjoyment of and provide protection for all persons using said property. The regulations will provide appropriate penalties and enforcement procedures for violations.
As used in this chapter, the following terms shall have the meanings indicated:
AGRICULTURAL USE
Open space property which is used for farming activities, including but not limited to the growth of agricultural crops.
MOTOR BOAT
Any boat or flotation device which is powered by other than muscular or wind power.
MOTOR VEHICLE
A vehicle propelled by other than muscular power, excluding a wheelchair and any other device used by persons with disabilities or handicaps.
MULTI-USE TRAIL
A trail constructed on open space property, to be used for hiking, biking, cross-country skiing, walking, jogging or similar recreational uses. The Town Council shall by resolution designate which Town open space properties shall be used as multi-use trails.
OPEN SPACE PROPERTY
Property owned by or licensed to or leased to the Town of Farmington and which is dedicated by deed, license or lease agreement as open space for conservation or agricultural use, use by hunters or sportsmen, leisure use, parks, playgrounds and multi-use trails as defined herein. Open space property shall not include school grounds.
RIGHT-OF-WAY
A parcel of land owned by the Town of Farmington in conjunction with a public road or passway.
SCHOOL GROUNDS
A parcel of land or portion thereof upon which is located a public school and associated grounds, operated by the Town of Farmington Board of Education and the Town of Farmington.
TOWN PROPERTY
Property owned by or licensed to or leased to the Town of Farmington, excluding open space, rights-of-way and school grounds. Examples of Town property include but are not limited to Town Hall, the Highway Department and sewer pump stations.
It shall be a violation of this chapter for any person to commit any of the following actions with respect to the properties listed:
A. 
To disturb, alter, enhance, destroy, remove or damage the land, wildlife, vegetation or improvements on any open space property, right-of-way, school grounds or Town property except as authorized by the Town Manager or his or her designee for any authorized agricultural use.
B. 
To leave, deposit, dump or throw any litter, trash, garbage or rubbish other than in a designated receptacle on any open space property, right-of-way, school grounds or Town property.
C. 
To erect, build or place any improvements or personal property on any open space property, right-of-way, school grounds or Town property except as authorized by the Town Manager or his or her designee.
D. 
To possess or discharge any firearm, fireworks or other hunting implement on any open space property, school grounds or Town-owned property except as permitted during Town-approved or -sponsored events or as permitted by the Town Manager or his or her designee; however, firearms and other hunting implements may be possessed and discharged in accordance with state law on open space property where hunting is permitted.
E. 
To set a fire of any type on any open space property, right-of-way, school grounds or Town property except as specifically authorized by the Town Manager or his or her designee and the Fire Marshal.
F. 
To apply chemical substances, including but not limited to fertilizers, pesticides, herbicides, etc., on the grounds of any open space property, right-of-way, school grounds or Town property except as authorized by the Town Manager or his or her designee.
G. 
To drive, operate or park any motor vehicle or motor boat except agricultural vehicles in conjunction with an authorized agricultural use, motorcycle, all-terrain vehicle, or snowmobile on any open space property, school grounds or Town property except on a road or parking lot or any area especially designated for motor vehicles by type and use as posted.
H. 
To be present on any multi-use trail or open space property except for open space property used for agricultural use, Westwoods Golf Course and Tunxis Mead-Thomas J. Quirk Park after 10:00 p.m. and before 5:00 a.m. except to participate in a permitted or supervised activity of the Town or as otherwise permitted by the Town Manager or his or her designee.
I. 
To be present on the Westwoods Golf Course property beyond the hours established and posted by the Director of Parks and Grounds except to participate in a permitted or supervised activity of the Town or as otherwise permitted by the Town Manager or his or her designee.
J. 
To be present on the Tunxis Mead-Thomas J. Quirk Park property after 12:00 midnight and before 5:00 a.m. except to participate in a permitted or supervised activity of the Town or as otherwise permitted by the Town Manager or his or her designees.
K. 
To be present on school grounds beyond the hours established and posted by the Farmington Board of Education or the Town of Farmington except to participate in a permitted or supervised activity of the Town or as otherwise permitted by the Superintendent of Schools or Town Manager or his or her designee.
L. 
To partake of any alcoholic beverage on any open space property except for Westwoods Golf Course and except as otherwise permitted by the Town Manager or his or her designee.
(1) 
No person shall partake of alcohol on school grounds or Town property except in conjunction with a permitted or supervised activity of the Board of Education or the Town or as otherwise permitted by the Superintendent of Schools or the Town Manager or his or her designees.
(2) 
No person shall partake of alcohol, cannabis, cannabis-derived products or smoking on the Westwoods Golf Course in violation of any rules established and posted for that facility.

M. 
To take onto any open space property, school grounds or Town property any dog or pet not on a leash which can be restricted to a maximum of six feet in length unless such pet is participating in a program sponsored by the Town.
N. 
No person shall partake of cannabis or cannabis-derived products, regardless of form or manner of ingestion, on any property owned or controlled by the Town of Farmington. This prohibition includes but is not limited to: the lighting or carrying of a lighted cannabis cigarette or cigar or pipe, use of vaping device producing vapor of any cannabis product, or carrying or ingestion of a cannabis edible substance.

O. 
No person shall partake in the smoking of tobacco, regardless of form on any property owned or controlled by the Town of Farmington. This prohibition includes but is not limited to: the lighting or carrying cigarette or cigar or pipe, use of vaping device production vapor of any tobacco product.

Any person violating any of the above provisions shall be fined not less than $50 nor more than $100, and/ or community service for not more than 20 hours per offense. Police officers shall issue citations for violations of any of the provisions set forth above. All moneys received shall be remitted to the office of the Tax Collector.
The hearing procedure for any citations issued for violations of the above regulations shall be the procedures set forth in Chapter 91 of the Code of the Town of Farmington, and the violator of any of the above regulations shall be substituted for the words "owner or keeper" in said Chapter 91.
