It shall hereafter be unlawful for any person to operate or have physical control over an off-highway vehicle (OHV) on property within the limits of the Town of Middletown without first having such vehicle registered as set forth in this chapter. For the purpose of this section, "off-highway vehicle" is a type of vehicle as defined in Title 21, Chapter 1, § 101(54), of the Delaware Motor Vehicle Law.
Every OHV operating within the town limits of Middletown must be in compliance with applicable sections of Title 21, Chapter 68, of the Delaware Motor Vehicle Law. In addition, prior to being operated within the Middletown Town limits, said OHV must be registered with the Town of Middletown.
An inspection of the OHV to be registered shall be conducted by a law enforcement agent of the Town of Middletown charged with enforcing this chapter. Said inspection is performed to ensure that the OHV is in compliance with the previously referenced Chapter 68. This process will also serve to officially document those vehicles that may be operating on designated lands within the Town limits.
A review of the OHV law will be conducted with the registrant at the time of registration.
A number will be assigned to each registered OHV. It shall be affixed to said vehicle in a manner described by the inspecting law enforcement official.
Registration shall be for a one-year period. Should the OHV be sold, transferred or otherwise change ownership, then said new owner(s) shall register the OHV prior to its being operated within the Town limits of Middletown.

Any person found to be in violation of this chapter shall be fined not more than $50 for each violation.
