The initial system of wastewater facilities in Kent County was activated in January 1973 to handle the present and future growth and development throughout the County. The purpose of this chapter is to set forth the procedures and requirements concerned with applying for service within this system. The regulations concentrate on:

The requirements of wastewater service and regulations of sewer use.
B. 
Good engineering practice in sewer system design and operation control.
C. 
Essential information on sewer system construction.
A. 
This chapter sets forth uniform requirements for direct and indirect contributors into the wastewater collection and treatment system for the Kent County Levy Court and enables the County to comply with all applicable state and federal laws required by the Clean Water Act of 1977 and the General Pretreatment Regulations (40 CFR 403).
B. 
The objectives of this chapter are to:
(1) 
Prevent the introduction of pollutants into the regional wastewater system which will interfere with the operation of the system or contaminate the resulting sludge.
(2) 
Prevent the introduction of pollutants into the County wastewater system which will pass through the system, inadequately treated, into receiving waters in concentrations or quantities in excess of State of Delaware Water Quality Standards or the atmosphere or otherwise be incompatible with the system.
(3) 
Prevent the introduction of pollutants into the wastewater system which will endanger the safety or health of Kent County personnel.
(4) 
Improve the opportunity to recycle and reclaim wastewater and sludges from the system.
(5) 
Provide for equitable distribution of the cost of the municipal wastewater system.
C. 
This chapter provides for the regulation of direct and indirect contributors to the municipal wastewater system through the issuance of permits to certain nondomestic users and through enforcement of general requirements against other users, authorizes monitoring and enforcement activities, requires user reporting, assumes that existing customer's capacity will not be preempted and provides for the setting of fees for the equitable distribution of costs resulting from the program established herein.
A. 
Upon adoption, this chapter shall apply to all direct or indirect users of the County wastewater system with the exception of exclusions provided herein. Section 180-9B, D, E, and F does not specifically apply to municipal contract users or Dover Air Force Base.
B. 
Articles IV and V of this chapter pertaining to design and construction do not specifically apply to municipal contract users or Dover Air Force Base with the exception of § 180-18C pertaining to flow measurement.
