The Township Council finds that, in order to preserve and safeguard the public health, safety and welfare, traffic and parking regulations are necessary in the parking areas, roadways, exits and entrances that exist on the property currently occupied by Charlie Brown's Restaurant, commonly known as "25 Linwood Avenue"; and Charlie Brown's Restaurant, a privately owned establishment open to the public or to which the public is invited, contributes significantly to the traffic and parking conditions in the area of the establishment during those times that the business is open to the public. It is therefore the purpose of the Township Council by this enactment to regulate traffic and the parking of vehicles in the traffic and parking areas of Charlie Brown's Restaurant and thereby preserve and safeguard the public health, safety and welfare.
Wherever used in this article, the following terms shall be deemed and construed to have the following meanings:
BICYCLE
A device having a wheel or wheels with pneumatic tires connected by a frame and arranged to be propelled exclusively by human power.
CHARLIE BROWN'S RESTAURANT
The commercial building and appurtenant access and parking areas located at 25 Linwood Avenue and designated as Block 2502.02, Lot 20, on the Tax Assessment Map of the Township of Washington (sometimes referred to as "Charlie Brown's" or the "premises").
CHARLIE BROWN'S RESTAURANT MAP
That map entitled "Site Plan/Erosion Control Plan - Charlie Brown's," Block 2502.02, Washington Twsp., Lot 20, Bergen County New Jersey, submitted by Lopatka Associates, Inc., and revised as of 12-29-1994. Attached to this site plan map is a Lighting Plan/Details Map which provides the traffic sign details. Said map is on file in the Clerk's office.
HANDICAPPED PARKING
Those parking stalls or parking spaces marked with signs and pavement markings which allow for the parking of vehicles which have handicapped parking license plates or authorized handicapped parking placards conspicuously posted on the vehicle. These stalls are designated on the Charlie Brown's Restaurant Map and are marked with signs and pavement markings giving notice thereof as shown on said map.
LOADING ZONE
That area of the establishment designated by sign which allows for the express purpose of the loading and unloading of goods and supplies for the establishment.
MOTORIZED BICYCLE
A pedal bicycle having a helper motor characterized in that either the maximum piston displacement is less than 50 cubic centimeters or said motor is rated at no more than 1.5 brake horsepower and said bicycle is capable of a maximum speed of no more than 25 miles per hour, on a flat surface and includes mopeds.

VALET PARKING
That company or those individuals employed by Charlie Brown's Restaurant for the purpose of parking patrons' vehicles on the premises of the Charlie Brown's Restaurant.
A. 
Vehicles. No vehicle shall park or stand in a zone prohibiting the same. No vehicle shall park in any area of Charlie Brown's premises except in parking stalls as designated in the Charlie Brown's Restaurant Map and marked with pavement markings giving notice thereof as shown on the map. No vehicle shall park, stop or stand in a zone prohibiting the same.
B. 
Bicycles and motorized bicycles. No bicycle or motorized bicycle shall park, stop or stand in a no-parking or no-standing zone.
C. 
Handicapped parking. No vehicle, bicycle or motorized bicycle shall park, stop or stand in any handicapped parking area, as designated in the Charlie Brown's Restaurant Map and marked with pavement markings and signs giving notice thereof, unless said vehicle bears approved handicapped personal identification such as license plates or authorized handicapped parking placards.
D. 
Parking on sidewalks, entrances, exits or on landscaped areas is prohibited.
A. 
No vehicle, bicycle or motorized bicycle shall be utilized for commercial loading or unloading except in the loading zone which is located on the northeast side of the building; provided, however, that such loading or unloading may be performed in any area designated for vehicle parking between the hours of 7:00 a.m. and 10:00 a.m. of any day.
B. 
Garbage removal may take place between the hours of 7:00 a.m. and 11:00 p.m. of any day.
A. 
Any federal, state, county or municipal emergency vehicle or United States Postal Service vehicle, while such vehicle is being utilized in the discharge of official duties, shall be exempt from the provisions of this article.
B. 
Valet parking. Should the owner of Charlie Brown's Restaurant choose to employ the services of a valet parking company or individuals who perform the services of parking patrons' vehicles, said company or individuals will be exempt from the provision of this article which requires all vehicles to be parked within a parking stall or parking space. However, said valet parking company or individuals who perform the service of parking patrons' vehicles must otherwise comply with all other provisions of this article and may not park vehicles in exits or entrances, within 50 feet of a stop sign or park vehicles in such a way as to constitute a potentially hazardous condition or violate any laws under Title 39 of the New Jersey Statutes. Should the Police Department determine that a hazardous condition exists, the valet parking company or those individuals responsible for creating the condition will make immediate efforts to correct the situation as prescribed by the Police Department.
Vehicles, bicycles and motorized bicycles shall adhere to the following traffic regulations within the parking lot, alleys, driveways, traffic ways, entrances and exits within the Charlie Brown's premises:
A. 
Stop at such intersections as shall be designated on the Charlie Brown's Restaurant Map and marked with signs and pavement markings giving notice thereof as shown on said map.
B. 
Proceed in the direction of those traffic lanes between parking stalls and traffic ways which exist in the front, side and rear of the building, as marked with pavement markings giving notice of said direction as shown on the Charlie Brown's Restaurant Map.
C. 
Pause and observe traffic before exiting from traffic lanes between parking stalls.
D. 
Refrain from entering areas that are marked as "Do Not Enter" by sign, as shown on the Charlie Brown's Restaurant Map.
E. 
Refrain from operating on any sidewalk.
F. 
As per the request of the owner of Charlie Brown's Restaurant and application to have the provisions of Subtitle 1, Title 39, of the Revised Statutes govern motor vehicle operations on the Charlie Brown's premises, the resolution of the Township Council of the Township of Washington granting said request, dated June 5, 1995, and upon approval by the Commissioner of Transportation, all traffic on the Charlie Brown's Restaurant premises will be governed by the motor vehicle and traffic laws of Title 39 of the New Jersey Statues.
A. 
Installations. All signs shall be procured, installed and maintained by owner of Charlie Brown's Restaurant. The cost of installation and maintenance of pavement markings shall be borne by the owner of Charlie Brown's Restaurant. The owner of Charlie Brown's Restaurant shall, subsequent to initial procurement and installation, maintain such signs and pavement markings. The owner of Charlie Brown's Restaurant shall repair, restore or replace the same within 30 days after receipt of written notice from the Chief of Police to do so, which notice shall be sent by certified mail to the address of said owner as shown on the Township tax records.
B. 
Specifications. All signs and pavement markings required by this article, and the installation thereof, shall conform to specifications established by law for signs and markings for like regulations of traffic on the public highways, including the MUTCD. If there be no such specifications for any particular sign or pavement marking, the same shall conform to specifications established by the Director of Public Safety, and the specifications so established shall, as nearly as practicable, be patterned after specifications for signs and markings for similar traffic regulations on the public highways. Such specifications shall be furnished to the owner of Charlie Brown's Restaurant by certified mail. The owner shall comply with these specifications within 45 days of receipt thereof.
C. 
Modification. The design and location of signs and pavement markings required under this article may be modified according to the following procedure:
(1) 
The Township Council shall have full authority to modify the design, location and amount of signs and pavement markings, by resolution duly adopted and served upon the owner of Charlie Brown's Restaurant.
(2) 
A resolution under this section shall provide that the Township of Washington shall effect such modifications at its expense or as may otherwise be provided by agreement between the Township of Washington and the owner of the Charlie Brown's Restaurant.
(3) 
A resolution under this section shall be served upon the owner of Charlie Brown's Restaurant, who shall maintain, repair and replace all signs and pavement markings.
(4) 
The Township Engineer shall amend the Charlie Brown's Restaurant Map in accordance with any resolutions under this section. All modifications under this section shall become effective as of the date of amendment of the Charlie Brown's Restaurant Map or the date of service of the resolution on the owner of Charlie Brown's Restaurant, whichever is later.
A. 
Entrances only. The following driveways shall be designated as an entrance only, as indicated on the attached Charlie Brown's Restaurant Map, which is incorporated herein and made a part thereof:
(1) 
That driveway on the southeast corner of the premises at Linwood Avenue.
B. 
Exits only. The following driveways shall be designated as exits only, as indicated on the attached Charlie Brown's Restaurant Map:
(1) 
That driveway on the northwest corner of the parking lot which exits onto Hemlock Drive.
C. 
Do not enter areas. The following areas shall be designated as do not enter areas, as indicated on the attached Charlie Brown's Restaurant Map:
(1) 
Located on the southeast corner of the property, facing north, prohibits vehicles from exiting onto Linwood Avenue from this area which is an entrance only area.
(2) 
Located opposite the southeast corner of the building, facing south, prohibits vehicles from traveling on the east side of the building. Exempt are commercial vehicle deliveries, garbage removal vehicles and employees of Charlie Brown's Restaurant.
(3) 
Located at the end of the dual entrance/exit, facing west, prohibits vehicles from entering the one-way entrance area in front of the building whose direction of travel is east to west.
(4) 
Located on the median which is located northwest of the fenced gates, facing west, prohibits vehicles from going through the gate area, traveling west to east. Exempt are commercial delivery vehicles, garbage removal vehicles and employees of Charlie Brown's Restaurant.
(5) 
Located on the northwest exit of the parking lot to Hemlock Drive, facing west, prohibits vehicles from entering the exit, traveling west to east.
(6) 
Located on the northeast section of the parking lot at the exit to the single lane driveway, facing west, prohibits vehicles from entering the driveway, traveling west to east.
D. 
Prohibited turns; left turn prohibitions. No person shall make a left turn at any of the following locations, as indicated on the attached Charlie Brown's Restaurant Map:
(1) 
Eastbound on Linwood Avenue into the southeast driveway on the premises.
E. 
Prohibited turns; right turn prohibitions. No person shall make a right turn at any of the locations, as indicated on the attached Charlie Brown's Restaurant Map:
(1)

F. 
Stop intersections. The following described intersections are hereby designated as stop intersections, whereby vehicles approaching the stop sign must come to a complete stop at the stop sign and proceed only after yielding the right-of-way to all traffic on the intersecting street which is so close as to constitute an immediate hazard. Stop signs will be placed at the following locations, as indicated on the attached Charlie Brown's Restaurant Map:
(1) 
The southwest corner of the dual entrance/exit. Vehicles traveling southbound, attempting to exit the lot, must stop before proceeding onto Linwood Avenue.
(2) 
Northeast driveway in the northeast area of the parking lot. Vehicles entering this driveway, traveling north and turning west, must stop at the end of this driveway before proceeding into the lot.
(3) 
Exit to Hemlock Drive on the northwest corner of the parking lot. Vehicles traveling westbound, attempting to exit the lot, must stop before proceeding onto Hemlock Drive.
G. 
Lane use reservations; one-way roadways. All vehicles shall move as provided below and as indicated on the attached Charlie Brown's Restaurant Map:
(1) 
Southeast entrance/driveway. Vehicles shall enter this driveway from Linwood Avenue and travel from the east to the west along the one-way roadway on the south side of the building.
(2) 
Northeast driveway. Vehicles entering this driveway from the northeast portion of the parking lot shall travel northbound into the driveway entrance and follow the driveway as it curves to the west. Vehicles will exit this driveway to the west.
(3) 
Northwest exit. Vehicles will enter the exit from the parking lot and proceed westbound while exiting onto Hemlock Drive.
(4) 
Southwest entrance/exit driveway. Vehicles entering the driveway from Linwood Avenue will proceed northbound into the parking lot. Vehicles exiting the parking lot shall travel southbound in this area and then exit the lot onto Linwood Avenue.
Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this article, or any supplement thereto, shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 10 days, or both. All unauthorized vehicles shall be towed away at the expense of the owner or driver.
