The First Logan Water Company is hereby authorized to lay and maintain its pipes and facilities beneath such public roads, streets and places as it may deem necessary for its corporate purposes and to construct and maintain hydrants on and along such public roads, streets and places in that portion of Logan Township described as follows:
Beginning at the low-water line of the northeast side of the Raccoon Creek, where said line meets the boundary line between Woolwich Township and Logan Township; thence in a northeasterly direction following the Woolwich Township - Logan Township boundary line to the point where said boundary line meets the Greenwich Township boundary line; thence in a westerly direction following the Greenwich Township - Logan Township boundary line to the point where said boundary line meets the southeasterly right-of-way line of New Jersey Route No. 44; thence along said southeasterly right-of-way line of New Jersey Route No. 44 in a southwesterly direction to its intersection with the southwesterly boundary line of Steelman Road; thence in a general southeasterly direction along said southwesterly side line of Steelman Road to the center line of the Pennsylvania-Reading Seashore Railroad; thence in a general southwesterly direction along the center line of said railroad to the low-water line of the northeasterly side of the Raccoon Creek; thence in a southeasterly direction along said low-water mark of the Raccoon Creek to the point and place of beginning, excepting and reserving therefrom the following premises, which shall not be part of the aforesaid franchise service area of the First Logan Water Company: Plate 11, Lots 20, 26, 27, 28, 30, 31 and 32, all in Block 51; Plate 11, Lots 1 and 2 in Block 52, and Plate 12, Lots 3 and 4 in Block 54.
Whenever such roads, places and/or streets shall be utilized for the purpose of laying pipes and facilities as may be necessary for purposes of the First Logan Water Company, the company shall be responsible for the repair and/or replacement of those areas of the public roads, streets and places.
The First Logan Water Company is hereby granted a franchise to provide water service in the section of the township described in § A159-1 of this ordinance.
The First Logan Water Company is hereby authorized to add to and extend its works to and within any municipality to such extent as may be necessary to carry out the corporate purposes pursuant to the provisions of N.J.S.A. 48:19-20.
The First Logan Water Company shall, within three years from the date of final passage of this ordinance, have constructed a well and water tank within the area described in § A159-1 of this ordinance and shall have completed at least some portions of a distribution system within three years from the date of the final passage of this ordinance. In the event the First Logan Water Company shall have failed to accomplish the within limited goals, its franchise shall be forfeit.
This ordinance shall take effect upon publication after final passage as provided by law.
