No rodeo, circus, carnival, tent show, children's ride, adult ride,
music festival or other outdoor performance shall be conducted in the Village.

Any person committing an offense against any provision of this article
shall, upon conviction thereof, be guilty of a violation pursuant to the Penal
Law of the State of New York, punishable by a fine not exceeding $250 or by
imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment.
The continuation of an offense against the provisions of this article shall
constitute, for each day the offense is continued, a separate and distinct
offense hereunder.

The intention of this article is to protect to the extent reasonably
practicable the expectations of homeowners in the residential districts of
the Village to customary and normal peace and quiet, particularly on weekends
and holidays and during the evening hours, by limiting the use of private
residences for large gatherings or assemblages of guests particularly for
fund-raising events, publicly advertised social events open to an unlimited
number of persons, commercially sponsored or supported social gatherings and
similar gatherings or assemblages which are not customary accessory uses of
single-family residences and which are reasonably likely to produce the extensive
parking of vehicles in an unregulated manner on either public or private roads,
excessive noise and visual distractions from the crowd or entertainment or
planned or unplanned activities at such gatherings or assemblage and the corresponding
imposition of these features or aspects of these gatherings or assemblages
on adjacent and nearby residential neighbors and the roads near the site of
such gathering or assemblage.
No provision of this article shall apply to weddings, funerals, bar
or bat mitzvahs or any similar kind of traditional family gathering limited
to specifically invited guests. In no event shall this law apply to any gathering
or assemblage sponsored by or conducted at a school, the Village Hall or religious
institution. The Board of Trustees may, by resolution, enlarge the exemptions
described in this section.

Any person(s), corporation(s), association(s), group(s) or other entity
seeking to hold a gathering or assemblage of 50 or more persons on private
property shall register same with the Village Clerk, without fee, at least
60 days prior to the expected date of said event and simultaneously notify,
in writing, by certified mail, return receipt requested, each improved adjacent
property owner within 300 feet of the perimeter of the proposed site of said
gathering or assemblage, with proof of notice by affidavit and return receipts
to be submitted prior to issuance of any permit, with the registration and
notice forms to be supplied by the Village Clerk. In no event shall there
be more than one such gathering or assemblage per calendar year.
Any said registration shall be referred to the Board of Trustees for
consideration and approval or denial of a permit to conduct said gathering
or assemblage. The Board of Trustees may require review of at least the following:
A.
Proposed method of providing off-street parking for guests,
including use of parking attendants and method of identifying person securing
cars off site.
B.
Noise attenuation details controlling bands or similar
or other noise sources.
C.
Anticipated number of persons in attendance.
D.
Hours.
E.
Security personnel on site, if any, including
method of identifying such persons.
F.
Outdoor lighting, if any.
G.
Accumulation of garbage or litter and method and timing
of disposal.
H.
Impact on available sanitary disposal systems.
I.
Names, addresses and telephone numbers of at least two
persons who shall be responsible for the event and present at the premises.
J.
Written executed consents from neighbors within the proximity described in § 47-5 above, if available. (Unavailability is not an impediment to approval.)
K.
Such other information as is reasonably requested by
the Board of Trustees.
L.
Written approval of Chief Fire Marshal of the Town of
Southampton for any tent greater than 400 square feet.

Any person who conducts a gathering or assemblage as described in § 47-5 without a permit under this article shall be guilty of a violation and, upon conviction, shall be subject to a fine of $250 for each violation.
