No person, fire or corporation shall construct or maintain a swimming pool, either artificial or natural, on private premises in the city, unless the same has been enclosed with a substantial protective fence at least four feet in height and permitting no space along the base thereof. Such fence may be constructed of any suitable material approved by the Building Official of the city and shall be equipped with a self-latching gate which shall be locked at all times when the swimming pool is unattended.
The Building Official shall approve all such fences, presently constructed or to be constructed in the future. Any private swimming pool not presently protected by a fence as above-described shall forthwith be so protected by the owner thereof.
Whoever violates any of the provisions of this chapter shall, upon conviction thereof in a summary proceeding, be fined $200 and costs of prosecution and, in default of such payment, be imprisoned for not more than 30 days.
