There is hereby established a department of municipal government of the Borough of Medford Lakes, to be known and designated as the "Police Department of the Borough of Medford Lakes." The office of Chief of Police is hereby affirmed. The Chief of Police shall be appointed by the Manager. The removal of the Chief of Police shall be in the manner and as provided by law.

There are hereby established the positions of Police Chief, Lieutenant (1), Sergeant (up to 2), Corporal (up to 2), and Patrol Officers (up to 5). In any event, the Department shall consist of no more than nine officers, regardless of rank. The creation of additional officer positions may be done only through the amendment of this section.

Appointments to or promotions within the Department shall be made by the Municipal Manager as provided by law, and as further set forth in § 4-23 below.
No person shall be appointed an officer or member of the Police Department unless:
A. 
He is a citizen of the United States.
B. 
He is sound in body and of good health sufficient to satisfy the Board of Trustees of the Police and Firemen's Retirement System of New Jersey that such person is eligible to membership in the retirement system, in the event such system is duly adopted by the Borough of Medford Lakes.

C. 
He is able to read, write and speak the English language well and intelligently.
D. 
He is of good moral character.
E. 
He shall, if so requested by the Municipal Manager, submit to and pass such physical examination conducted by a qualified physician designated by the Municipal Manager.

F. 
No person shall be eligible for appointment who has been convicted of any crime constituting an indictable offense, or who has been convicted of any crime or offense involving moral turpitude that in the judgment of the Municipal Manager would be prejudicial to the morale or effectiveness of the Police Department.
G. 
No person shall be eligible for appointment who does not fall within any age category as may be established by state statute or regulation, and provided that nothing herein contained shall be construed to prohibit the continuance in office or employment of any person who is permanently employed by the municipality in the Police Department at a fixed annual salary and whose sole occupation is that of police officer.

All applicants for appointment as members of the Police Department or as special law enforcement officers shall complete and file with the Municipal Manager a written application on a form to be prescribed by the Borough Council and furnished by the Borough Clerk.
The Municipal Manager may, in his discretion, administer an examination to be given to each applicant, either written or oral, or both, the purpose of which shall be to test the mental and moral fitness of the applicant.

The Borough Manager, as the appropriate authority, shall promulgate rules and regulations for the government of the force and for the discipline of its members. Such rules and regulations shall thereafter be adopted by ordinance circulated by the Chief of Police to the officers and each officer shall sign an acknowledgement and be bound by same. A copy shall also be made available to the Borough Council.

The Director of the Department of Public Safety shall have and exercise the following authority and shall perform the following duties:
A. 
He or she shall advise Borough Council with regard to policy on all matters of a police nature.
B. 
He or she shall consult with and advise the Municipal Manager on all matters of policy affecting the Police Department as established by Borough Council.
The Municipal Manager shall have supervisory responsibility for the conduct of the Police Department and the efficient and effective operation thereof. He shall be the "appropriate authority" as set forth in N.J.S.A. 40A:14-118. The Municipal Manager shall be responsible for the enforcement by the Police Department under the direction of the Chief of Police of the applicable laws of the state and ordinances of the Borough, and administration of the rules and regulations prescribed for the conduct and control of the Department.
A. 
He shall, in the exercise of his authority and in order to accomplish his duties, issue such orders and give such instructions as he may from time to time deem necessary or proper in the operation, administration and management of the Police Department and in relation to the work of the special law enforcement officers assigned to active duty.
B. 
He shall, in the event of an emergency involving the protection of life or property or the preservation of the public peace, health and welfare, whenever he may deem it advisable, take command of the police officers and the special law enforcement officers assigned to active duty, and direct their operations in the discharge of their duties.
C. 
He shall take whatever other action and measures are necessary to promote the effective and efficient management and control of the Police Department.
The Chief of Police shall be the head of the Police Department. He shall be directly responsible to the appropriate authority for the efficiency and routine day-to-day operations of the Police Department.
The Chief of Police shall, pursuant to policies established by the appropriate authority:
A. 
Administer and enforce rules and regulations, and special emergency directives for the disposition and discipline of the force and its officers and personnel as promulgated by resolution, ordinance, or the appropriate authority;
B. 
Have, exercise and discharge the functions, powers and duties of the force;
C. 
Prescribe the duties and assignments of all subordinates and other personnel;
D. 
Delegate such of his authority as he may deem necessary for the efficient operation of the force to be exercised under his direction and supervision;
E. 
Be on duty eight hours during the daytime, as his normal duty shift, or as may be directed by the Manager. Emergent matters will dictate different scheduling. Because of the small size of the Police Department, it is the policy directive of the Borough Council that unless departmental conditions require otherwise, at the discretion of the Manager, the Chief of Police shall spend an average of four hours per day on the road.
F. 
Furnish to Borough Council a monthly operations report at least three days prior to the second regular Borough Council meeting of the month which shall include:
(1) 
General daily activity of all members of the Police Department.
(2) 
General condition of police vehicles and equipment so as to provide full accountability of police vehicles and equipment.
G. 
Review the reports and recommendations of the Lieutenant regarding discipline and the conduct of all members of the police force and make record of any delinquencies or charges calling same to the attention of Borough Manager including the recommendation for dismissal from the force.

H. 
Arrange for the training schedule of all members including refresher courses. Advise the Borough Manager concerning training programs with recommendations for Manager to act upon.

I. 
Administer the rules and regulations governing the Police Department including standards of uniforms and the wearing thereof.
J. 
Investigate and examine all applicants for appointment to the force furnishing Borough Manager with a written report of such investigation.

K. 
Post in advance schedules of vacation periods to be approved by the Borough Manager.
L. 
Carry out the policies of the Borough Manager.
M. 
Attend Borough Council meetings monthly (last meeting of the month) to answer any questions which may arise from the monthly reports, the public or Council members; attend any special meeting of the Borough Council if requested to be present.
N. 
Furnish reports or studies which the Borough Council may from time to time deem it helpful and appropriate in measuring the efficiency and service of all the members of the Department in carrying out the policies of the Borough Council.
O. 
Make recommendations for promotion in rank as well as commendations in conjunction with the Borough Manager, where appropriate, with final approval to be by Borough Manager.
P. 
Be responsible for the quality and effectiveness of police services rendered by his subordinates.
Q. 
Make recommendations to the Borough Council and Borough Manager regarding the adoption of rules and regulations for the control, disposition and discipline of the Police Department. Such rules may pertain to training, efficiency, the use and care of equipment and apparatus.

R. 
Be available at all times to the Manager or to the officer in charge, subject to reasonable vacation scheduling, for emergent matters by telephone (land line or mobile), pager or other effective means of communication.

The Police Department shall consist of the Chief of Police and such number of Lieutenants. Sergeants, Corporals and patrolmen as may be determined from time to time by ordinance of the Borough Council. The Lieutenant, if there be but one Lieutenant, or the Senior Lieutenant, if more than one, shall be designated as the officer in charge of internal affairs.
The salaries for the members of the Police Department shall be established by the Borough Council in the Annual Salary Ordinance or as amended during the year.
All members of the Police Department shall, before entering upon the performance of their duties, take and subscribe an oath of office and such other oaths as may be required by law.

The Chief of Police, Lieutenants, Sergeants, Corporals, and patrolmen shall have the power and authority conferred upon members and officers of such police force by N.J.S.A. 40A:14-118 and 40A:14-152.
The Chief of Police shall be subordinate to the Manager and shall receive his orders from the Manager.
The Borough Council shall at all times have full power and authority to amend or supplement this article and the rules and regulations which are hereafter adopted, to repeal any part of this article, to repeal or supplement any one or more of the regulations.

It shall be the duty of the members of the Police Department and special law enforcement officers when assigned to active duty to see to the enforcement of all applicable state laws and ordinances of the Borough; and to preserve order and prevent infractions of the law and to arrest violators thereof. Every member of the Police Department and special law enforcement officers shall conduct themselves in a proper and law abiding manner at all times, and avoid the use of unnecessary force. Each member of the Department and special law enforcement officers shall obey the orders and directions of his supervisors and shall comply with the provisions of this article and the rules and regulations of the Department.

The Municipal Manager may appoint special law enforcement officers for a term not exceeding one year. Such appointments may be revoked for cause after adequate hearing, unless the appointment is for four months or less, in which event, the appointment may be revoked without cause or hearing. They shall not be members of the Police Department, and their powers, rights and duties shall immediately cease at the expiration of the term for which they were appointed as such special law enforcement officer unless the person:
A. 
Is a resident of this state during the term of appointment;
B. 
Is able to read, write and speak the English language well and intelligently and has a high school diploma or its equivalent;
C. 
Is sound in body and of good health;
D. 
Is of good moral character;
E. 
Has not been convicted of any offense involving dishonesty or which would make him unfit to perform the duties of his office;
F. 
Has successfully undergone the same psychological testing that is required of all full-time police officers in the municipality;
(1) 
Every applicant for the position of special law enforcement officer appointed pursuant to this section shall have fingerprints taken, which fingerprints shall be filed with the Division of State Police and the Federal Bureau of Investigation;
(2) 
Every such special law enforcement officer shall be under the supervision and direction of the Chief of Police except as otherwise provided in this article.
(3) 
Every such special law enforcement officer shall perform his or her duties only when expressly assigned to active duty and only within the limits of the municipality except when in fresh pursuit of any person pursuant to the provisions of N.J.S.A. 2A:156-1 et seq.
(4) 
Every such special law enforcement officer shall comply with the provisions of this section and the rules and regulations promulgated for the conduct and decorum for the regular members of the Police Department.
(5) 
Appointments as special law enforcement officers shall be made in accordance with N.J.S.A. 40A:14-146.8 et seq., and their duties and qualifications shall be as set forth therein.
(6) 
Pursuant to N.J.S.A. 40A:14-146.17, it is hereby established that the number of Class One Special Officers shall be limited to 10, and the number of Class Two Special Officers shall be limited to three. The classifications shall be based upon the duties to be performed by the special law enforcement officer as follows:
(a) 
Class One: Officers of this class shall be authorized to perform routine traffic detail, spectator control and similar duties. Class One officers shall have the power to issue summonses for disorderly persons and petty disorderly persons offenses, violations of municipal ordinances and violations of Title 39 of the Revised Statutes. The use of a firearm by an officer of this class shall be strictly prohibited, and no Class One officer shall be assigned any duties which may require the carrying or use of a firearm.
(b) 
Class Two: Officers of this class shall be authorized to exercise full powers and duties similar to those of a permanent, regularly appointed full-time police officer. The use of a firearm by an officer of this class may be authorized only after the officer has been fully certified as successfully completing training as prescribed by the Commission.

A. 
Authorization.
(1) 
Members of the Borough's Police Department, whether they be full-time or part-time, are expressly authorized to engage in security-related and traffic control activities during their off-duty hours for private persons or entities, so long as the arrangements therefor are made through this municipality and any compensation paid to the officers for such service is channeled through this Borough.
(2) 
The officers performing said off-duty services authorized hereunder are also authorized to wear a Borough police uniform; however, nothing herein shall in any way imply or be deemed to express any commitment or obligation by the municipality to pay said officers compensation for overtime or extra-duty work; in fact, the governing body hereby disclaims any such commitment, obligation, or responsibility.
(3) 
The authorization set forth in this section shall apply only to security-related and traffic control activities during off-duty hours for private persons or entities.
(4) 
In granting this authorization, the Borough of Medford Lakes assumes no responsibility or liability for the actions or nonactions of the off-duty officers.
B. 
Compensation.
(1) 
All compensation to be paid to said officers by the private persons or entities shall be first paid by said person or entity to the Borough. The amount to be paid to the Borough shall be set forth by resolution of the governing body and shall include charges for hourly performance of traffic control/security in a Borough uniform and utilizing a police vehicle, hourly performance where the officer is in uniform and not utilizing a police vehicle, and an administrative charge for police and/or vehicle(s). Compensation to officers hereunder shall include taxes and other deductions required to be made by the Borough Treasurer. Under no circumstances will the Borough advance monies to the officer involved.

(2) 
The Borough shall request that escrow be deposited by the private person or entity requesting the service. The amount of escrow shall be based upon the estimated amount of time and cost for the service requested. The Treasurer shall deposit the moneys collected from said private persons or entities for payment of the extra-duty officers into a special trust fund. All members of the Police Department shall be paid for services performed on the regular pay date, upon submission of a pay slip approved by the Chief of Police or his designee and properly authorized by the private person or entity. Any unused escrow shall be returned to the private person or entity after completion of the requested service. If additional amounts are owed, the private person or entity shall be invoiced by the Borough, and that invoice shall be paid within 10 days. If a private person or entity has any outstanding invoices, the Borough may choose to refrain from the provision of off-duty police services until such invoices are paid in full.

(3) 
Pursuant to memoranda issued by the State of New Jersey Department of the Treasury, Division of Pensions, dated August l989, and February l990, it is the express intention of this section that off-duty work authorized by this section shall entitle police officers to coverage under the Police and Firemen's Retirement System where they are injured during off-duty or outside employment authorized by this section. Both the Borough and the members of the Borough's Police Department are familiar with these memoranda and, because the employees shall ultimately be subject to departmental discipline and control, and because they are paid by the Borough, albeit at a rate of pay not their regular or overtime rate, they are in accordance with the February l990 memorandum prepared by Douglas R. Forrester, Director, Division of Pension, above hereto and made a part hereof, considered to be covered for injury or death which may occur while performing those duties.
(4) 
Extended service. In the event of a prolonged detail of a nonuniform nature, the fee shall be subject to negotiation between the Police Department and the company requesting the services, subject, however, to first approval by the Borough Council.
(5) 
Benefits. Social security, Medicare, employer and disability and other payroll deductions and benefits shall remain the responsibility of the third-party entity requesting the police officers' services.
(6) 
Minimum pay. Unless a particular assignment is specifically scheduled for a period of less than four hours, the minimum pay for each officer's service shall be for a period of four hours. In addition, the third-party entity requesting the services must provide a two hours' notice of cancellation, and, if notification is not made at least two hours prior to the scheduled commencement time, the four-hour minimum pay requirement shall be complied with.
C. 
Insurance; agreement. Prior to commencing off-duty employment for private persons or entities, the officers must obtain from said person or entity the following:
(1) 
A fully executed agreement in the form which is above hereto (agreement attached to original ordinance) and made a part of this section[1];

(2) 
Written assurance that the officers are covered by the private employer's workmen's compensation insurance and personal liability insurance policies, which insurance shall include a copy of said insurance policies and shall provide for a minimum coverage of $1,000,000 for any one claim or $2,000,000 for any aggregate claims;
(3) 
Such other information or documentation as may from time to time be required by the governing body.
D. 
Indemnification. Any private person or entity requesting the services of extra-duty police officers shall indemnify and hold harmless the Borough of Medford Lakes, its officials and employees, for any and all damages which may arise from the officer's employment by said private person or entity.
E. 
Supervision by Chief of Police.
(1) 
The Chief of Police of the Borough of Medford Lakes shall be responsible for the overall conduct of the members of his department in following the rules and regulations promulgated herein, and shall insure that the terms, conditions and provisions of this section shall be fully and faithfully carried out. Additionally, the Chief of Police shall have authority to control officers engaged in off-duty or outside employment pursuant to this section, and shall further have the authority to discipline any and all officers so engaged in outside employment, should cause for such charges arise or exist.
(2) 
The Chief of Police, or his designee(s), shall be responsible for the assignment of all off-duty police-related activities and the billing of all compensation due to the Borough.
F. 
Utilization of municipal vehicles. Police officers engaging in off-duty activities, as authorized and required by this section, may be permitted to utilize a municipal vehicle subject to the approval and consent of the Chief of Police.
G. 
Emergency. The Chief of Police, or his designee, shall have the authority to order any police officer engaged in an off-duty assignment to respond to an emergency within the Borough. He, and his designee, shall further have the right to terminate any off-duty assignment if he determines that the assignment creates an unacceptable risk to the health, safety and welfare of the off-duty officer or the Borough and its residents. In the event of emergency or termination as described above, the private entity or person shall not be responsible for the payment of the officer's hourly rate, except for those hours already incurred.
H. 
Exceptions; adjustments.
(1) 
The Borough Council reserves the right to amend the above fees for nonprofit groups and/or other municipal or county organizations.
(2) 
The fees established herein may be amended in the future by resolution of the Borough Council.

A. 
Purpose. The purpose of this section is to provide all eligible candidates for promotion with fair notice and equal access to the promotional process. Additionally, the goal of this section is to strive to identify the most qualified members of the Police Department for promotion to leadership positions within the Department and to set forth the components of the promotional process that will be utilized in carrying out the process.
B. 
"Promotion" defined. "Promotion" denotes vertical movement or advancement in the organization hierarchy from one rank to another, usually accompanied by increases in salary. The promotional process begins with identifying employees who have the potential for assuming greater responsibility and who possess the skills, knowledge, maturity and abilities required to perform at the level being considered for promotion. It is the intent of the governing body to utilize a promotional process governed by state law as well as in compliance with applicable standards of the Commission on Accreditation of Law Enforcement Agencies, Inc. As used below, in any promotion that includes a minimum-years-of-service requirement, it shall be understood that continuous years of service are required. Should there be any break in service, such service time will be recalculated from the date service is resumed.
C. 
Promotion to the rank of Corporal.
(1) 
Eligibility. No person shall be eligible for a promotion to the rank of Corporal unless that person shall have served as a police officer for at least three years and at least one year with the Medford Lakes Police Department prior to the deadline for submission of a letter of intent to participate in the promotional process.
(2) 
Educational requirement. While a degree in higher education is encouraged by the Borough, special consideration will be given to those officers currently employed by the Borough as of January 1, 2014, who do not have a higher education degree in the consideration of promotion to Corporal. Generally, no person shall be eligible to participate in the process for promotion to the rank of Corporal unless that person shall have obtained an Associates Degree (or sixty-four-credit equivalent) or Bachelors Degree (or one-hundred-twenty-eight-credit equivalent). This requirement may be waived based upon cumulative criteria, such as years of experience, at the discretion of the Medford Lakes Borough Manager. Candidates for promotion that have obtained a degree shall be required to submit an official college transcript or diploma evidencing satisfaction of this requirement, unless the candidate has already submitted same and one is on file in connection with the candidate's initial appointment as a police officer.
(3) 
Testing. Candidates for Corporal shall participate in the testing process set forth in Subsection F of this section.
(4) 
Background investigation. A review of the candidate's personnel, training and background investigation files will be conducted. An up-to-date background investigation shall be conducted. Falsification of any record or document would lead to the candidate being rejected or dismissed from the process.
D. 
Promotion to the rank of Sergeant.
(1) 
Eligibility. No person shall be eligible for a promotion to the rank of Sergeant unless that person shall have served as a police officer for at least five years and at least three years with the Medford Lakes Police Department. Additionally, the officer must have served at least one year at the rank of Corporal prior to the deadline for submission of a letter of intent to participate in the promotional process. The above requirements with regard to years of service as an officer, with the Department, or in a lower rank may be relaxed by the Township Manager as the appropriate authority, provided that the Manager provides a written statement to Council for the basis of the waiver.

(2)

(3)

Background investigation. A review of the candidate's personnel, training and background investigation files will be conducted. An up-to-date background investigation shall be conducted. Falsification of any record or document would lead to the candidate being rejected or dismissed from the process.
E. 
Promotion to the rank of Lieutenant.
(1) 
Eligibility. No person shall be eligible for a promotion to the rank of Lieutenant unless that person shall have served in the Medford Lakes Police Department for at least five years prior to the deadline for submission of a letter of intent to participate in the promotional process. Additionally, the officer must have served at least two years at the rank of Corporal or higher prior to the deadline for submission of a letter of intent to participate in the promotional process. The above requirements with regard to years of service as an officer, with the Department, or in a lower rank may be relaxed by the Township Manager as the appropriate authority, provided that the Manager provides a written statement to Council for the basis of the waiver.

(2)

Falsification of any record or document would lead to the candidate being rejected or dismissed from the process.
F. 
Testing process for promotion.
(1) 
The Chief of Police shall obtain permission from the Borough Manager to hold a promotional examination process. After having received such approval, the Chief of Police or his designee shall provide a written announcement of the promotional process to all sworn personnel. The announcement shall include a recitation of the eligibility and educational requirements, if any, for the position. Candidates for promotion shall be required to submit a written request to the Chief of Police or his designee prior to the closing date of the announcement to participate in the process. The announcement shall include a description of the promotional process and should indicate to candidates the format, length and duration of any examinations, together with a description of any other portions of the promotional process, any minimum cut-off scores to continue to advance and a numerical weight assigned to each element. No person shall be eligible to participate in the promotional process unless he or she has submitted a written request prior to the deadline set forth by the Chief of Police or his designee.
(a) 
Written examination. At least 45 days before the written examination, the Chief of Police or his designee shall announce the date, time and location of the written examination. The Chief of Police shall obtain authorization from the Borough Manager to enter into a contract with New Jersey State Association of Chiefs of Police, the International Association of Chiefs of Police or other comparable testing entity to develop, conduct and grade the written multiple-choice examination. The written examination will consist of a series of multiple-choice questions. The Chief of Police or his designee may submit or suggest any appropriate topic areas or questions to the outside testing entity to include in the examination. These questions will be based upon basic police practices and may include police and investigative procedures, supervisory and administrative principles, New Jersey criminal law, report writing, search and seizure issues, New Jersey Attorney General Guidelines and Directives and legal aspects and requirements of police work. The Chief of Police or his designee shall provide a written announcement of the reading list or syllabus of possible sources of materials utilized in developing the test in order for candidates to prepare for the written examination. Eligible candidates who are scheduled to work during the written examination will be excused from duty to take the examination. The written examination shall account for 15% of a candidate's promotional score. A review of the candidate's personnel, training and background investigation files shall account for 15% of the candidate's promotional score. Falsification of any record or document would lead to the candidate's being rejected or dismissed from the process.
(b) 
Panel interview. Candidates for promotion shall be evaluated by a panel for an oral interview. The oral interview panel shall consist of five members (two members of the Borough Council, the Chief of Police, and one Chief of Police retired or current from another municipality). For purposes of the oral interview the Borough Manager will be present. Each candidate shall be presented with the same questions or topics, designed to elicit open-ended responses so that the oral interview panel can determine the candidate's promotional potential, maturity, composure and leadership abilities. Each member of the oral interview panel shall rate the candidate based upon a score of 1 to 100 in the oral interview. The scores will then be added and divided by the number of oral interviews to arrive at the candidate's score for the oral interview phase. Candidates for promotion, as well as members of the oral interview panel, shall not discuss or disclose the contents or subject matter topics of the oral interview process until after all oral interviews are concluded. The Borough Manager or his designee may require promotional candidates and oral interview panel members to sign a confidentiality and nondisclosure agreement[1] to insure compliance with these requirements. The interview panel will make its scores available to the Borough Manager. The cumulative calculations will be averaged by the Manager, which shall account for 15% of the candidate's promotional score.

Borough Manager interview. Candidates for promotion shall be interviewed by the Borough Manager. Each candidate shall be presented with the same questions or topics, designed to elicit open-ended responses so that the Borough Manager can determine the candidate's promotional potential, maturity, composure and leadership abilities. The Borough Manager shall rate the candidate based upon a score of 1 to 100 in the oral interview. The Borough Manager interview shall account for 55% of the candidate's promotional score.

Appointments to or promotions within the Department shall be made by the Municipal Manager as the appointing authority as provided by law.
G. 
Lateral entry or lateral transfers. No lateral entry or lateral transfer is permitted from another agency to a promotional rank within the Police Department.
H. 
Security of promotional materials. The Borough Manager or his or her designee shall be responsible for the security and custody of promotional materials. All promotional materials will remain in the secured promotional file located in the office of the Borough Manager or such other secure area as designated by the Borough Manager.
I. 
Reconciliation with Chapter A240. To the extent the above amendments conflict with Chapter A240, an attempt shall be made to reconcile the provisions, and where reconciliation is not possible the provisions of Chapter A240 that are found to be in conflict are hereby repealed.

The position of Police Chaplain for the Medford Lakes Police Department is hereby created in accordance with N.J.S.A. 40A:14-141. The position will be a volunteer position. The position of Chaplain shall be under the Chief of Police.
Any person appointed as Chaplain shall be an ordained clergyman in good standing in the religious body from which he/she is selected. The Chaplain shall have basic training and shall be a certified Police Chaplain credentialed in accordance with the policies of the Medford Lakes Police Department and shall be qualified in accordance with N.J.S.A. 40A:14-141.
The duties of Police Chaplain shall include, but not be limited to, assisting the Medford Lakes Police Department in death notifications, station house adjustments, and any other duties that may be assigned by the Chief of Police.
Any person appointed as Chaplain shall serve in that capacity without rank or salary.
A person appointed as Chaplain shall serve for a period of one year from the date of appointment and shall continue to serve in that capacity until he/she is either terminated or reappointed with the recommendation of the Chief of Police.
The Chief of Police may recommend to the Borough Manager persons that he/she believes meet the qualifications of N.J.S.A. 40A:14-141 as well as the policies of the Police Department with reference to Chaplains, if any. All applicants for the position of Chaplain shall be reviewed by the Chief of Police, Senior Police Chaplain and Chaplain liaison to determine his/her qualifications in accordance with this chapter and shall make recommendations to the Borough Manager regarding the appointment as Chaplain. The Borough Manager shall appoint Chaplains in accordance with this chapter with the advice and consent of Borough Council.
