Editor's Note: The preamble to this ordinance read as follows:
WHEREAS, at the General Election held in November 1941, there was submitted to the voters of the City of Ventnor City, the question of whether or not the City of Ventnor City should adopt the provisions of the Civil Service Act of the State of New Jersey, and said adoption was duly approved and authorized by a majority of the voters of the City of Ventnor City at said election; and
WHEREAS, immediately thereafter the Civil Service Commission of the State of New Jersey made a survey of all city officers and employees, covering the duties, salaries and respective departments of said employees; and
WHEREAS, following such survey the Civil Service Commission has submitted to the Common Council of the City of Ventnor City two separate and distinct schedules, as follows:
Schedule 1. A complete list of the employees of the City of Ventnor City giving suggested titles for each employee, the salary of the same and the department to which such employee is assigned.
Schedule 2. A duties classification of the employees, setting forth the suggested titles to be used for the employees of the City of Ventnor City, their respective duties, typical tasks, minimum qualifications for the purpose of examination and suggested salary schedules and whereas the Common Council is now prepared to adopt a schedule classifying positions but is not at this time prepared to adopt and establish minimum and maximum rates of compensation for those positions.
NOW, THEREFORE, BE IT ORDAINED by the Common Council in and for the City of Ventnor City, New Jersey, that . . .
The schedule referred to herein and recommended by the Civil Service Commission of the State of New Jersey to this body for adoption consisting of the following is hereby made a part of this chapter in its entirety, the same as though specifically set forth herein, said schedule being filed with the City Clerk coincident with the passing of this chapter: Schedule 1, a schedule of all positions in the City of Ventnor City and containing under such positions the duties, typical tasks, minimum qualifications and probable line of promotion for each such position, is hereby adopted by this body as the official civil service classification of positions in and for the City of Ventnor City.
For the purpose of effecting and maintaining the classification and salary standardization plan recommended by the Civil Service Commission of the State of New Jersey, the following regulations are hereby adopted and shall be in full force and effect with respect to all positions and employees in the City of Ventnor City, said regulations to apply to the contents of Schedules 1 and 2 hereinabove referred to and hereby adopted, as well as to the terms of this chapter.
A. 
The specifications herein provided shall apply to all existing authorized offices, positions and employments or such as have been established or created in the classified civil service in the City and shall supersede all groupings of employments not consistent thereto and shall be applied subject to the conditions in these regulations.
B. 
The specifications herein provided shall not in themselves be construed to define or prescribe the organization or procedure under which employees shall work, nor to limit or restrict the responsible administrative officials in exercising supervision or assigning such other duties as may be in the interest of good administration or necessary in case of emergency; provided, however, that this chapter shall not be interpreted as authorization to assign, detail or transfer an employee to a position involving duties of an essentially different character.
C. 
The standard titles as set forth in Schedule 1 shall be applied to all existing offices, positions and employments in the classified civil service of the City of Ventnor City. Changes in titles shall not alter or affect the salaries of the present incumbents of offices or positions so rearranged.
D. 
The standard titles shall be used to designate positions in all reports to the Civil Service Commission, departmental records and all payrolls or accounts of salaries and wages of all departments, institutions and commissions submitted to the Civil Service Commission for check and certification.
E. 
All departmental requests for additions to or changes in the specifications involving either the classification or compensation schedules, together with full reporting of maintenance requests, shall be first presented to the Board of Commissioners, which shall, as it deems proper, forward the requests, together with their recommendations, to the Civil Service Commission for investigation and consideration. No reclassifications or changes in compensation schedules or maintenance allowances shall be effective until they have received the approval of both the Board of Commissioners and the Civil Service Commission.
F. 
When new positions are to be created, there shall be submitted by the department head, through the Board of Commissioners, to the Civil Service Commission a statement of the duties, qualification requirements and other matters affecting the proper classification, title, grade and compensation and of the necessity for the creation of such position. No office or employment shall be considered new unless the duties thereof are found to be substantially different from those of every other existing position in the classified service of the City. When the Civil Service Commission shall find that an office or employment is, in fact, new or that the requested changes affecting any existing position should be made, the Commission shall so classify such position under the appropriate service, grade and title, and it shall become a part of the classification of the City of Ventnor City upon approval by the Board of Commissioners and the Civil Service Commission.
G. 
Appointments to newly created or vacant offices or employments shall be made at the lowest rate within the standard range of compensation for such office or employment. In cases of promotion where the employee to be promoted is receiving compensation equal to or greater than the minimum rate established for the position to which promotion is to be made, appointment shall be made at the nearest next salary rate higher than the compensation received by such employee.
H. 
Advancement to the next higher rate within the range of compensation provided for a particular position shall be conditional upon service at each rate for at least the period specified in the schedules or later determined by the Board of Commissioners and upon satisfactory efficiency in the performance of the specified duties.
I. 
Advances in compensation from rate to rate within the range for each position shall be made at such periods as may be determined by the Board of Commissioners for all officers and employees who are eligible for advancement after the completion of the designated period of satisfactory service. Unless otherwise provided, proof of satisfactory and meritorious service shall be established for all employees in the classified civil service through efficiency records of the departments, which shall be kept in accordance with existing laws, rules and regulations and in the form approved by the Civil Service Commission.
J. 
Where efficiency records are kept in an office in accordance with the Civil Service Act, no advancement in salary shall be granted to an employee whose average net efficiency for the six months preceding the date of request for advancement in salary is less than 75%.
K. 
Nothing in these regulations, the rules of the Civil Service Commission or the action of the Board of Commissioners in adopting the classification and salary standardization plan shall be construed to mean that it shall be mandatory upon the head of the department, institution or commission to advance an officer or employee to the next higher rate within the range of compensation provided for the position merely because such officer or employee has served at the lower salary rate for a certain period of time.
L. 
An increase above the maximum salary rate of an existing position shall not be made except in case of increased duties or responsibilities which actually involve a change of position or until changes in the prevailing compensation schedule for the position or positions in question are made as provided in Subsection E.
M. 
Promotions from one class to the next higher class of positions in the classified civil service shall involve a change of duties and shall be made only when a vacancy has been created by resignation, transfer, death or dismissal or when the needs of the service require additional employees in the higher position.
N. 
All employees of the City of Ventnor City on November 4, 1941, the date on which civil service was adopted in the City of Ventnor City, who are presently employees of the City of Ventnor City shall continue to receive the salaries which they are now receiving until the same are changed as provided in these regulations and by such regulations as may be hereafter adopted by Board of Commissioners.
O. 
All employees appointed since the adoption of civil service in the City of Ventnor City, namely, since November 4, 1941, shall, upon the adoption hereof, take the minimum salary prescribed by the ordinance or ordinances thereunto pertaining, according to the classification or position to which they shall have been appointed.
P. 
All new employees appointed after the adoption of this classification plan shall be appointed at the minimum rate now established for such position.[1]

WHEREAS, the New Jersey Civil Service Commission, at the request of the Ventnor City Council, pursuant to their resolution adopted at their regular meeting held December 4, 1967, has completed a reclassification survey and salary study of the nonuniform positions in the City of Ventnor City, and
WHEREAS, the New Jersey Civil Service Commission has submitted to the local governing body of said jurisdiction, three separate and distinct schedules, as follows:
SCHEDULE 1 — A list of employees, together with their dates of last permanent appointment, present salary, present title of position and division classification, and proposed title of position, divisional classification and indicating Civil Service administrative action;
SCHEDULE 2 — Class specification in alphabetical order, including definitions, examples of work, educational and experience requirements, knowledge and ability;
SCHEDULE 3 — a) An alphabetical list of all titles, their divisional classification and proposed salary ranges for full time positions;
b) In schematic arrangement, a list of titles of full time positions and proposed salary ranges and divisional classification;
c) In descending order, a list of titles of full time positions, showing proposed salary ranges;
d) An alphabetical list of titles in the Unclassified Service, with statutory or other provisions which place the positions in Unclassified Service;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF VENTNOR CITY, NEW JERSEY, that:. . .
The classes of positions and duties assigned thereto as set forth in the three schedules referred to above and incorporated herein by reference and listed are hereby created and adopted.[1]
