From and after the final passage of this article,
it shall be unlawful for any person, firm or corporation to burn any
trash, rubbish, animal or vegetable refuse or garbage in such a manner,
whether it be in an open bonfire, grate, stove, furnace or incinerator,
as to cause the emitting of smoke or noxious fumes.
The burning of trash, rubbish, animal or vegetable
refuse or garbage in such a manner as to cause the emitting of smoke
or noxious fumes is hereby declared to be a menace to the public health,
comfort and safety of the inhabitants of Ventnor City.

Any person, firm or corporation violating the
provisions of this article shall, upon conviction thereof before the
Judge of the Municipal Court of Ventnor City, be subject to a fine
of not more than $1,000 or to imprisonment in the City or county jail
for a period not to exceed 30 days. In addition to or as a substitute
for the previously mentioned fine, the imposition of community service
shall be authorized as an additional penalty, which community service
shall not exceed 90 days.
