In accordance with N.J.S.A. 40:48-2.46, a municipality
under N.J.S.A. 39:4-197 may create an ordinance for the regulation
of entrances to and exits from parking yards within said City, as
well as regulate vehicular and pedestrian traffic and the parking
of vehicles in parking yards and parking places which are open to
the public or to which the public is invited, whether maintained or
operated separately or in conjunction with any business or enterprise.

Within the boundaries of the City of Ventnor City
is property known as the "Ventnor Shopping Plaza," which plaza is
located on Wellington Avenue in said City. Within said shopping plaza
will be located handicapped parking spaces, which parking spaces are
intended to be designated by the operators within that plaza.

By the implementation of this article, the City of
Ventnor City, through its Police Department, shall regulate and ensure
that the handicapped parking spaces that are created within the Ventnor
Shopping Plaza are maintained for that purpose and are used by only
those individuals or persons who are entitled to park in said locations.
C.Â
Anyone who violates the handicapped space locations
within the Ventnor Shopping Plaza shall be issued a summons by any
authorized representative of the Ventnor City Police Department as
a violation of this article.

The City of Ventnor City is authorized in applying
and enforcing the provisions of Subtitle 1, Title 39, Motor Vehicles
and Traffic Laws of the Revised Statutes of New Jersey, which apply
to roads leading into and out of the Ventnor Shopping Plaza and to
all traffic and vehicles within said Ventnor Shopping Plaza.

Any individual, person or entity found guilty
of a violation of this article shall be subject to a penalty not to
exceed $1,000. In addition to or as a substitute for the previously
mentioned fine, the imposition of community service shall be authorized
as an additional penalty, which community service shall not exceed
90 days.
