In accordance with N.J.S.A. 39:4-138d, no operator
of a vehicle shall stand or park the vehicle in front of a public
or private driveway. The City of Ventnor City hereby establishes that
the width of a driveway within the City of Ventnor City, whether public
or private, where no parking shall be permitted shall constitute the
linear footage of width of the depressed curb of the driveway, plus
36 inches beyond the depressed curb in each direction along the curbline.
Property owners of the private or public driveway
may construct traffic markings within the street area defining the
no-parking area of the driveway in accordance with details and material
requirements on file with the Chief of Police and/or Construction
Code Official. It shall not be the responsibility of the municipality
to construct or maintain such pavement markings. Such markings not
performed in accordance with the details and material requirements
shall be removed by the property owner. Failure to remove the same
within 30 days of written notice to the property owner by the Municipal
Construction Code Official shall cause the municipality to remove
the same at the property owner's expense.
Any individual, person or entity found guilty
of a violation of this article shall be subject to a penalty not to
exceed $500. In addition to or as a substitute for the previously
mentioned fine, the imposition of community service shall be authorized
as an additional penalty, which community service shall not exceed
90 days.
