Abandoned or junked motor vehicles or cycles upon privately owned property within the unincorporated area of the town is a matter affecting the public interest. It constitutes a nuisance and is detrimental to the safety, the health and the welfare of the public, constituting an attractive nuisance to children and a peril to their safety. It is hereby declared that the adoption of this chapter has for its purpose the effective termination of such practices.
As used in this chapter, the following terms shall have the meanings indicated:
ABANDONED VEHICLE OR CYCLE
One which is parked or left on private property, other than property owned or leased by the owner of the vehicle, without an intent to operate said vehicle, whether left with or without the consent of the owner or lessee of said property.
JUNKED MOTOR VEHICLE OR CYCLE
One which is physically or legally incapable of being operated on a public street or highway and where the cost of repair to make it capable of being so operated is greater than the value thereof as shown in the value book of the NADA Used Car Guide. A motor vehicle shall be presumed to be a junked vehicle if it is not duly registered and is dismantled or partly dismantled or dilapidated or is in a rusted or wrecked condition or lacks equipment in good operating condition necessary to enable it to be operated or required by law to enable it to be registered.
A. 
It shall be unlawful for any person, firm, corporation or agent or employee thereof to park, place or deposit or cause or permit to be parked, placed or deposited or to leave an abandoned or junked motor vehicle or cycle on any private land not under cover within the unincorporated area of the Town of Ossining.
B. 
This chapter shall not apply to properties occupied and used for the repair, reconditioning and remodeling of vehicles in conformance with the Zoning Ordinance of the Town of Ossining.[1]

Any person violating any of the provisions of this chapter shall be liable for and pay a penalty of not to exceed $250 and/or imprisonment for not more than 15 days.

In addition thereto, if the provisions of § 186-3 are not complied with, the Building Inspector of the Town of Ossining shall personally serve or cause to be personally served a written notice upon the owner, lessee or occupant of any premises to comply with the provisions of this chapter. If the owner of such land is absent from the town or is a nonresident of the town, the Building Inspector shall mail such written notice to such owner, addressed to the last known address as the same shall appear upon the current assessment roll, by certified mail return receipt requested. If the person upon whom the notice is served fails, neglects or refuses to comply with the provisions of said notice within 10 days after such service or mailing, the Building Inspector shall cause such abandoned or junked motor vehicle to be removed and such nuisance to be suppressed. The cost of removal shall be certified to the Town Clerk and shall be assessed upon the premises on which such abandoned or junked motor vehicle is found and shall constitute a lien and charge on the premises on which it is levied until paid or otherwise satisfied or discharged and shall be collected in the manner provided by law for the collection of delinquent taxes.
