[HISTORY: Adopted by the Borough Council of the Borough of Wilkinsburg 7-31-1972 as Ch. XV, Part 1, of the 1972 Code. Amendments noted where applicable.]
A. 
As used in this chapter, the following terms shall have the meanings indicated:
PERSON
Includes any natural person, partnership, association, firm or corporation.
B. 
In this chapter, the singular shall include the plural, the plural shall include the singular, and the masculine shall include the feminine and the neuter.
No person shall distribute any handbill or other advertising matter or advertising device whatever in the Borough of Wilkinsburg by casting or scattering the same upon any of the streets, sidewalks, alleys or public places in the borough. This shall not prevent any person from handing any noncommercial literature or other printed matter, upon any of the streets, sidewalks or alleys in the borough, to any person willing to receive the same.
No person shall distribute any handbill or other advertising matter or advertising device whatever in the Borough of Wilkinsburg without first having procured from the Borough Manager a permit for such distribution. No such permit shall be issued until the applicant therefor shall have paid the permit fee, which shall be for the use of the borough and which shall be as set forth from time to time by resolution of the Borough Council.[2] If any holder of any such permit shall be convicted of a violation of any provision of § 105-2 of this chapter, such permit shall be revoked by the Mayor, and no further permit shall be issued to such person until one (1) year shall have expired. No part of a permit fee shall be refunded when a permit shall have been revoked.

Any person who shall violate any provision of this chapter shall, for each and every such violation, upon conviction thereof, be sentenced to pay a fine of not more than six hundred dollars ($600.) and costs of prosecution and, in default of payment of such fine and costs, to imprisonment for not more than thirty (30) days.
