Pursuant to the provisions of the Municipal Port Authorities Law (P.L. 1960, c. 192) of the State of New Jersey,
The Camden Municipal Port Authority hereby created is a Municipal Port Authority, as contemplated and provided for by said Municipal Port Authorities Law, and shall have and exercise all of the powers and perform all of the duties provided for by said Municipal Port Authorities Law and any other statutes heretofore or hereafter enacted and applicable thereto.
In recognition of the powers and authority granted to the South Jersey Port Corporation for port development in the South Jersey Port District under the South Jersey Port Corporation Act, the Camden Municipal Port Authority shall not be authorized to establish, acquire, construct, rehabilitate, improve, own, operate or maintain any marine terminals, as defined in N.J.S.A. 12:11A-3, which will compete with facilities of the South Jersey Port Corporation. Nothing contained in the order of the Superior Court of New Jersey, as entered on March 29, 1978, shall preclude the South Jersey Port Corporation from determining that any particular marine terminals or parts thereof do not compete with facilities of the South Jersey Port Corporation, and such determination shall be sufficient evidence of the noncompetitive aspect of such marine terminals within the provisions of this section.
Members of the Camden Municipal Port Authority will receive no compensation for their services as members of the Authority.
A copy of this chapter, duly certified by the City Clerk of the city, shall forthwith be filed by said City Clerk in the office of the Secretary of State of the State of New Jersey, in the office of the Division of Local Government Services in the Department of Community Affairs of said state and in the office of the City Clerk.
A copy of this chapter, duly certified by the City Clerk, shall be forwarded also to each authority, board, commission, public corporation or other public body existing or established to exercise powers for port purposes in a Port District or other district or area, by or pursuant to an act of the Legislature of the State of New Jersey, alone or in conjunction with the Legislature of another state, the district or area of operation of which includes, in whole or in part, the city.
