§ 228-1 Applicability.

A. 

This chapter shall apply to every person who is engaged as an entertainer, model or dancer in any commercial establishment for a period in excess of two days for compensation or remuneration of any kind. It shall also include disc jockeys, musicians and magicians.

B. 

The provisions of this chapter shall not be applicable to any entertainer, model or dancer employed by, in or upon behalf of any educational institution created, maintained, established or licensed as such by the State of New Jersey.

C. 

The provisions of this chapter shall not be applicable to any entertainer, model or dancer employed by, in or upon behalf of any organization qualifying as a tax exempt organization, pursuant to Section 501(c)(3) or Section 504(c)(4) of the Internal Revenue Code of 1954 (Act of August 16, 1954, c. 736), as amended and supplemented through and including such enactments of the First Session of the 95th Congress, and commonly referred to as the "Internal Revenue Code of 1978."

§ 228-2 Age restriction on licenses.

No license shall be issued hereunder to any person who has not attained 18 years of age.

§ 228-3 Failure to comply.

It shall be unlawful for any person, as defined in § 332-1, to engage in the activity identified and regulated by this chapter, without first having obtained a license therefor and paid the fee required for such license, both as provided in Chapter 332, Licenses and Business Regulations. Any person engaging in such activity who shall fail to comply with any provisions of this chapter or of Chapter 332 shall be in violation of the provisions of this chapter.

§ 228-4 Violations and penalties.

A. 

Unless otherwise provided in the chapter, penalties against persons violating the provisions of this chapter shall be imposed in accordance with the provisions of § 1-16A.

B. 

A separate offense shall be deemed committed on each and every day for each and every violation of this chapter.

C. 

A separate offense shall be deemed committed on each day during or on which a violation or violations occur or continue.

D. 

The imposition of a fine or imprisonment as punishment for a violation of any provision of this chapter shall not be deemed to be in lieu of any provision of this chapter or of Chapter 332 providing for revocation or suspension of any license issued under this chapter and Chapter 332.
