Except as hereinafter provided, the Police Department of the
City of Pleasantville, as heretofore established, in accordance with
N.J.S.A. 40A:14-118, and the officers, members and employees thereof
are hereby continued.
The headquarters of the Pleasantville Police Department heretofore
established in the Police Station, situated on First Street, Pleasantville,
New Jersey, is hereby continued. It shall be open for the transaction
of business at all hours of the day and night, including Sundays and
holidays.
The appropriate authority shall, from time to time as may be
necessary, adopt and amend the rules and regulations for the government
and discipline of the Police Department and employees thereof. Said
rules and regulations may fix and provide for the enforcement of such
rules and regulations and the enforcement of penalties for the violation
of such rules and regulations, and all employees of the Police Department
shall be subject to such rules and regulations and penalties.
In accordance with N.J.S.A. 40A:14-118, the right is hereby
reserved by the Council of the City of Pleasantville to amend or to
revoke any of the rules and regulations or to add to or amend thereto
as the circumstances require. This will be done after consultation
with the Mayor and Chief of Police.
All rules, regulations, procedures and orders previously issued
contrary to those embodied in the Police Department Manual as provided
for herein are hereby revoked. All other rules, regulations, orders
and procedures not in conflict with those contained in the manual
as provided for herein shall remain in force.
A Police Directive Management System is established herein.
The Directive Management System shall include the rules and regulations
as promulgated and amended from time to time by the appropriate authority
as well as all general orders of the Police Department. The Directive
Management System will be maintained both electronically and in hard
copy in the Police Department and an electronic copy of the Directive
Management System shall be provided to each officer.
All members and employees of the Police Department who are assigned
a copy of the Directive Management System shall be responsible for
its maintenance and care. All copies of the Directive Management System
shall be kept current, and supplementary additions, revisions and
amendments shall be properly and promptly maintained. Each police
officer and each civilian employee is duty-bound to thoroughly familiarize
himself/herself with the provisions of the Directive Management System.
Failure to comply with the terms of this section shall be considered
neglect of duty.
In the event that neglect of duty is charged against a member
of the Police Department for failure to observe the rules and regulations,
general orders or other procedures of the Department, ignorance of
any provision of the Directive Management System or any Department
procedure or order shall not be accepted as a defense.
All terms utilized in this chapter and which are utilized in
all aspects of the Directive Management System shall have the meaning
provided for and defined in the rules and regulations.
The position of Chief of Police is established as provided for
in N.J.S.A. 40A:14-118. The Chief of Police shall be the head of the
police force and he shall be directly responsible to the appropriate
authority for the efficiency and routine day-to-day operations thereof
and he shall pursue policies established by the appropriate authority,
including:
A.
Administer and enforce the rules and regulations of the Police Department
and any special emergency directives for the disposition and discipline
of the Department and its officers and personnel.
B.
Have, exercise and discharge the functions, powers and duties of
the Police Department.
C.
Prescribe the duties and assignments of all subordinates and other
personnel.
D.
Delegate such of his authority as he may deem necessary for the efficient
operation of the Police Department to be exercised under his direction
and supervision.
E.
Report at least monthly to the appropriate authority in such form
as shall be prescribed by the governing body on the operation of the
force during the preceding month, and make such other reports as may
be requested by the governing body.
The Patrol Division is responsible for the performance of the
following functions:
A.
Preventive patrol activities.
B.
Protection of life and property, preservation of the peace, enforcement
of the law and suppression of crime.
C.
Investigation of police incidents and minor crimes and preliminary
investigation of serious crimes.
D.
Traffic law enforcement, traffic control and traffic accident investigation.
E.
Assignment, control and supervision of reserve police and school
crossing guards.
The Investigation Division is responsible for the following
functions:
A.
Follow-up investigations of serious crimes, vice crimes and fatal
motor vehicle accidents.
B.
Preparation of cases for prosecution.
C.
Recovery of stolen property.
D.
Performance of all identification functions.
E.
Prevention and control of juvenile delinquency.
F.
Maintaining liaison with the juvenile courts.
The City of Pleasantville is a civil service employer. All hiring
for Police Department positions and all promotions within the Police
Department shall be in accordance with Title 11 of New Jersey Statutes
and any Administrative Code provisions promulgated thereunder.

A.
Pursuant
to NJ S3672, the Civil Service Commission shall exempt from the requirement
to take an examination for an entry-law enforcement position a person
who has successfully completes a full Basic Course for Police Officers
training course within nine months from the date of hire as a temporary
entry-level officer, at a school approved and authorized by the New
Jersey Police Training Commission.
B.
The law
also requires that a municipal or county police department may hire
a person under this exemption only upon adoption of a conflict of
interest and nepotism policy.
C.
The City
of Pleasantville has established a conflict-of-interest policy pursuant
to the City of Pleasantville Personnel Policies and Procedures Manual
Section 4.6 Conflict of Interest and Section 15.1 Anti-Nepotism Policy.
D.
The City
Council wishes to enact S3672 and in addition mandate that applicants
given consideration under this section, applicants must be bona fide
City of Pleasantville residents.

When officers are of the same grade, they shall rank according
to their seniority determined by time to rank. When two or more officers
are appointed to the same grade on the same day, each shall rank according
to his respective position on the eligibility list which determined
the order of his appointment to that grade.
There shall be a permanent committee of the City Council of
the City of Pleasantville called the "Public Safety Committee." The
Public Safety Committee shall consist of three members of City Council,
who shall be appointed by the President of City Council, who may appoint
himself as one member.

The Public Safety Committee shall assist the Mayor, upon request,
in the supervision of the Police Department and shall render such
advice and aid to the Mayor or his/her designee, as may be necessary
from time to time to ensure proper and efficient functioning of the
Pleasantville Police Department.
A.
The Mayor of the City of Pleasantville shall be the appropriate authority
for the Police Department vested with the functions and regulatory
power established pursuant to N.J.S.A. 40A:14-118 and by law.
B.
The Chief of Police shall be the head of the police force and shall be directly responsible to the Mayor or his/her designee as appropriate authority for the efficiency and routine day-to-day operation thereof, and the Chief shall, pursuant to policies established by the Mayor as the appropriate authority, administer duties as detailed in § 48-10 above.

C.
The Public Safety Committee of the City Council of the City of Pleasantville
shall be the hearing tribunal (referred to as "hearing officer") with
jurisdiction to conduct all disciplinary action as provided for in
the Police Department Rules and Regulations and the New Jersey statutes
and as authorized by law.
D.
The Pleasantville Police Department rules and regulations shall be
and hereby are established, adopted, enacted and reaffirmed as the
rules and regulations for the government of the police force and for
the discipline of its members.

The appointment of any officers, members or employees of the
Pleasantville Police Department shall not take effect until confirmation
by a majority vote of the entire membership of City Council.
There is hereby established within the organization of the Police
Department of the City of Pleasantville a Traffic Safety Unit.
The Chief of Police shall assign as many police officers to
the Traffic Safety Unit as he may, from time to time, determine to
be necessary.
The Chief of Police shall determine the functions and responsibilities
of the Traffic Safety Unit. These will be in accordance with directives,
laws, rules and regulations and ordinances of the City of Pleasantville.

The police rate of $80 per hour will be charged by the City
of Pleasantville for any police detail work.
