For the purposes of this chapter, the use of the masculine pronoun shall
be deemed to apply to the feminine, and vice versa; the use of the singular
number shall be deemed to apply to the plural; the use of the word "person"
shall be deemed to apply to individuals, partnerships, limited liability companies
and corporations.
A.
AGGRESSIVELY BEG
BEG
OBSTRUCT PEDESTRIAN OR VEHICULAR TRAFFIC
As used in this chapter, the following terms shall have
the meanings indicated:
To beg with intent to intimidate another person into giving money
or goods.
To ask for money or goods as a charity, whether by words, bodily
gestures, signs or other means.
To walk, stand, sit, lie or place an object in such a manner as to
block passage by another person or a vehicle, or to require another person
or a driver of a vehicle to take evasive action to avoid physical contact.
B.
Prohibited acts.
(1)
No person shall sleep in or on the street, sidewalks,
public parks or other public places in the city or obstruct or interfere with
the passage of any person or persons lawfully being on or upon said streets,
public parks or other public places.
(2)
No person while in an intoxicated condition or under
the influence of liquor shall be upon or assemble upon the streets, sidewalks,
public parks or other places in the City of Pleasantville.
(3)
No person, while upon any highway, sidewalk or other
public place, shall intentionally obstruct pedestrian or vehicular traffic
or aggressively beg. Acts authorized as an exercise of one's Constitutional
right to picket or to legally protest and acts authorized by a permit issued
pursuant to the Code of the City of Pleasantville shall not constitute obstruction
of pedestrian or vehicular traffic.
(4)
No person shall, while upon any highway, sidewalk or
other public place, accost or annoy any person or persons upon such places.
(5)
No person shall revel, quarrel, brawl or otherwise misbehave
in a disorderly manner to the disturbance or annoyance of the peaceable inhabitants
of the city.
(6)
It shall be unlawful for any person to willfully and
maliciously give or make or cause to be made a false fire, first-aid, air-raid
or police alarm.
(7)
It shall be unlawful for any person to commit any act
constituting lewd, immoral or indecent conduct, unlawful destruction of property,
willful injury to or unlawful interference with any person, a hazard to the
public health or disturbances of the peace not otherwise expressly prohibited
herein.
(8)
No person shall be guilty of any other disorderly conduct
as provided by law in or on the streets, sidewalks, public parks or other
public places.
Any person violating any of the provisions of this chapter shall, upon
conviction in the Municipal Court of the City of Pleasantville, be punished
for each offense by a fine not to exceed $500 or by imprisonment for any term
not exceeding 90 days in the county jail or in any place provided by the municipality
for the detention of prisoners, or both.
