[HISTORY: Adopted by the City Council of the City of Pleasantville 6-7-1982 by Ord. No. 11-1982 as Ch. 178 of the 1982 Code. Amendments noted where applicable.]
GENERAL REFERENCES
Construction contractors — See Ch. 121.
Street openings — See Ch. 255, Art. II.
Installation of water mains — See Ch. 285, Art. I.
No person shall remove or excavate sand or gravel from any lands within the city limits without first obtaining a permit therefor from the Council.
A. 
Application for such permit shall be in writing and signed and sworn to by the person making application therefor.
B. 
Each application shall set forth:
(1) 
Location and size of the land from which it is proposed to remove the sand or gravel or make the excavation.
(2) 
Name or names of the owner or owners of the land.
(3) 
Purpose for which the removal or excavation is to be made.
(4) 
Estimated number of cubic feet of sand or gravel to be removed.
(5) 
What means or method of removal is to be employed so that the removal and excavation shall not constitute a public nuisance.
A. 
Each application for a permit shall be:
(1) 
Accompanied by payment of the permit fee of $25.
(2) 
Filed with the City Clerk.
B. 
If the Council shall refuse to issue the permit, the permit fee shall be returned to the applicant.
Any person who violates any provision of this chapter shall, upon conviction thereof, be punished by a fine of not less than $100 nor more than $1,000, imprisonment for a term not exceeding 90 days and/or a period of community service not exceeding 90 days.
