adopted as Ch. 139 and was renumbered in order to be consistent with
the alphabetical sequence of the subject matter of the Code.
This chapter shall be known and cited as the
"Residential Swimming Pool Ordinance" and shall provide safeguards
for swimming pools, wading pools and reflecting pools within the City.
Definitions shall be as follows for the purpose
of this chapter:
If any portion of a pool has a depth greater than 24 inches
of water when full, such pool shall be classified as a "swimming pool."
Any permanent pool which has a maximum depth of between 12
inches and 24 inches to the normal waterline shall be classified as
a "wading or reflecting pool," depending upon its intended use.
The water supply used for filling or for cleaning
of the pool shall be clean. The water supply shall be protected against
potential pollution from all sources, including cross-connection and
backflow.
No person shall maintain a private swimming
pool, either artificial or natural, without first safeguarding it
with a substantial protective fence at least four feet in height equipped
with self-latching gates as approved by the Building Inspector. This
section does not apply to fences safeguarding swimming pools existing
prior to July 9, 1962. In such cases, the Building Inspector is authorized
and directed to approve such existing fences which, in his discretion,
substantially comply with this article. All approvals of the Building
Inspector must be made in writing.
A wading or reflecting pool, if within 15 feet
of a street or public thoroughfare, shall be protected by an approved
fence or railing not less than three feet high. In lieu of a fence
or railing, the Building Inspector may, in his discretion, approve
other safeguards, including shrubs, plantings or similar appurtenances
which afford a comparable degree of protection. This section does
not apply to fences or other appurtenances safeguarding such pools
existing prior to July 9, 1962. In such cases, the Building Inspector
is hereby authorized and directed to approve such existing safeguards
which, in his discretion, substantially comply with this article.
All approvals of the Building Inspector must be made in writing.
The fee for building, electrical and plumbing permits will be as per the fee schedule in § 138-21.
Water rates for swimming pools within the City shall be as set forth in § 255-75.
