Certain documents, one copy of which is on file in the office of the Borough Council and one copy of which is on file with the Sayre Borough Solicitor, being marked and designated as the "International Residential Code," including Appendix Chapters, as published by the International Code Council is hereby adopted as the code of the Borough of Sayre for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of one- and two-family dwellings and townhouses not more than three stories in height in the Borough of Sayre, and providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, conditions and terms of such International Residential Code, 2000 Edition, published by the International Code Council on file in the office of the Borough Secretary are hereby referred to, adopted and made a part hereof as if fully set out in this article.
The following sections are hereby revised:
A. 
In Section R101.1 insert: "Sayre."
B. 
Section R113.5 is added to read as follows:

R113.5 Violations and penalties: Any person who violates a provision of this Code is subject to the following:
1.
Prosecution of ordinance violators; disposition of fines, penalties and costs: Any violation or failure to comply with any provision of any borough ordinance shall constitute a summary offense and prosecution for every such offense shall be according to the practice in the case of summary convictions.
2.
Collection of penalties: No fine or penalty shall exceed $1,000 for a violation of a building, housing, property maintenance, health, fire or public safety code or ordinance and for water, air and noise pollution violations, and shall not exceed $600 for a violation of any other borough ordinance.
3.
Any person who shall violate any provisions of this chapter shall, upon conviction thereof, be punishable by a fine of not more than $1,000, plus costs of such proceedings, or by imprisonment in the County Jail for a term of not more than 30 days, or both. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
C. 
In Table R301.2(1) insert: "Minimum design loads for buildings and other structures (ASCE-7) and Appendix A-K."
D. 
Section R112.1 General. The review board shall be the Sayre Code Review Board appointed by the Sayre Borough Council which will hear all appeals of the Code Enforcement Officer’s decision to enforce the ordinance. All appeals shall be filed within 30 days of notice of the violation. Said Appeals Board shall consist of three members appointed by Council for initial terms of one year, two years, and three years. Thereafter each Board member shall, upon the approval by Council, serve a term of five years. The qualifications for the Board will be determined based on the recommendation by the Borough Council who are qualified by experience and training to pass on matters pertaining to the ordinance. The Code Review Board fee shall be $750 plus costs and may be amended from time to time by the municipality for the administration and appeals undertaken pursuant to this chapter and the Code shall be established by the governing body by resolution.

Ordinance No. 707 of Borough of Sayre, entitled "CABO One and Two Family Dwelling Code, 1992 Edition," and all other parts of ordinances in conflict herewith are hereby repealed.
The Borough Secretary is hereby ordered and directed to cause this article to be published.

Certain documents, one copy of which is on file in the office of the Borough Council and one copy of which is on file with the Sayre Borough Solicitor, being marked and designated as the "International Building Code," including Appendix Chapters, as published by the International Code Council, Inc., be and is hereby adopted as the Building Code, of the Borough of Sayre, in the Commonwealth of Pennsylvania; for the control of building and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code are hereby referred to, adopted and made a part hereof, as it fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in § 55-7 of this article.
The following sections are hereby revised:

Ordinance No. 710, of the Borough of Sayre, entitled "Building Code BOCA, 1993," and all other ordinances or parts of ordinances in conflict herewith are hereby repealed.
Nothing in this article or in the Building Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 55-8 of this article; nor shall any just or legal right to remedy of any character be lost, impaired or affected by this article.
The Borough Secretary shall certify to the adoption of this article and cause the same to be published as required by law; and this article shall take effect and be in force from and after its approval as required by law.
