There be and is hereby created, in the Town of Guilford, a Guilford Pool Commission, the members of which shall be appointed by the Board of Selectmen. The Commission shall consist of nine regular members, who must be electors of the town. Insofar as practicable, members appointed shall be representative of all groups interested in the operation of the Guilford Pool. No more than five shall be from one political party.
Initially, the Board of Selectmen shall appoint three members to the Commission to serve for a term of one year, three members to serve for a term of two years and three members to serve for a term of three years or until a successor is appointed or qualified. Thereafter, all appointments shall be for a term of four years or until a successor is appointed and qualified. Vacancies shall be filled for the unexpired term by the Board of Selectmen. Members of the Commission shall serve without pay.
The members of the Commission shall meet and elect a Chairperson and such other officers prior to the 1st of December, annually or as may be necessary.
The Commission shall hold regular meetings and shall designate the time and place thereof and shall have the power to adopt rules and regulations for the conduct of business within its jurisdiction and shall keep a record of all its proceedings. Five members shall constitute a quorum. When a member shall fail to be present at four consecutive meetings or at 1/4 of meetings held in any fiscal year, his or her membership shall be vacant, unless his or her absence shall be excused by the Commission and the reason thereof entered in the record of the Commission's proceedings.
The powers and duties of the Guilford Pool Commission shall be exercised and performed as herein provided in conformity with town ordinances.
A. 
The Commission shall determine the nature and extent of community interest for a pool facility and type of aquatic facilities needed.
B. 
The Commission will investigate and consider various locations to determine the best, most accessible and cost effective site for a town pool facility.
C. 
The Commission shall prepare and develop a long-range plan for development, construction and administration of a town pool facility
D. 
The Commission shall prepare and develop a long-range financial plan for construction, operation and administration of a town pool facility.
E. 
The Commission shall prepare, develop and present all information to various boards and commissions required to obtain approvals, as well as civic organizations.
F. 
The Commission shall have the power to call upon any other department of the town government for assistance in the performance of its duties and to cooperate with any other department of the town in projects of mutual interest.
The Commission, at the regularly designated time, shall submit an estimate of anticipated expenditures and revenues for the coming fiscal year. The Commission shall operate within the budget as approved by the Board of Selectmen.
The Commission shall, from time to time, but not less often than annually, make a report to the Town Meeting relative to the work of the Commission and shall submit such other reports as may be requested from time to time.
