A. 
Established; composition; Administrator. There is hereby established in the Borough of Alpine a State Uniform Construction Code enforcing agency to be known as the "Construction Code Enforcement Office," consisting of a Construction Official, Building Code Official, Plumbing Subcode Official, Electrical Subcode Official, Fire Protection Subcode Official and such other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency. Personnel of the Borough presently involved in the responsibilities noted above are to be assigned, as may be necessary, to the Construction Code Enforcement Office.
B. 
Qualifications for official positions. Each official position created in Subsection A shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217, N.J.S.A. 52:27D-119 et seq., as amended, and N.J.A.C. 5:23, provided that in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217, N.J.S.A. 52:27D-119 et seq., and N.J.A.C. 5:23, to hold each such position.
C. 
Public business at one location. The public shall have the right to do business with the enforcing agency of one office location, except for emergencies and unforeseen or unavoidable circumstances.
In lieu of a Construction Board of Appeals to hear appeals from decisions by the enforcing agency, such appeals may be made to the county board or state board as provided by statute.
Compensation of personnel assigned to the Construction Code Enforcement Office in accordance with § 97-1A of this chapter shall be at the same rate as set forth in the Borough of Alpine Salary Ordinance.

A. 
Construction permit fee; sum of subcode fees. The fee for a construction permit shall be the sum of the subcode fees and shall be paid before the permit is issued.
(1) 
Building subcode fee. The building subcode fee shall be:
(a) 
For new construction: $0.010 per cubic foot of building or structure volume, provided that the minimum residential fee shall be $300 and the minimum commercial fee shall be $500.
(b) 
For renovations, alterations, roofs, siding and repairs:

Residential: $40 per $1,000 of estimated cost of the work, provided that the minimum residential fee shall be $100.
[2] 
Commercial: $60 per $1,000 of estimated cost of the work, provided that the minimum commercial fee shall be $200.
(c) 
For additions: $0.010 per cubic foot of building or structure volume for the added portion, provided that the minimum residential fee shall be $300 and the minimum commercial fee shall be $500.
(d) 
For combinations of renovations and additions: the sum of the fees computed separately as renovations and additions.
(e) 
For construction of a swimming pool, hot tub, spa, water feature, outdoor kitchen, outdoor fireplace, and any other recreational facility or any other appurtenant structure:

Residential: $40 per $1,000 of estimated cost of such structure and appurtenances, provided that the minimum residential fee shall be $100.
[2] 
Commercial: $60 per $1,000 of estimated cost of the work, provided that the minimum commercial fee shall be $200.
(2) 
Plumbing/mechanical subcode fee. The plumbing subcode fee shall be:
(a) 
Forty dollars per plumbing fixture or device to be installed, provided that the minimum residential fee shall be $100 and the minimum commercial fee shall be $200. For the purpose of computing this fee, fixtures shall include lavatories, kitchen sinks, slop sinks, water closets, bathtubs, shower stalls, laundry tubs, dishwashers, or other similar devices.
(b) 
Special devices.

Air-conditioning units: $90 per appliance.
[2] 
Gas piping: $75 per appliance.
[3] 
Hot-water storage tanks: $90.
[4] 
Grease traps: $90.
[5] 
Oil separators: $90.
[6] 
Heating Systems — Boiler, steam or water, hot air furnance or similar devices: $180.

Generators: $180.
[8] 
Hot water heater, gas or electric: $90.

Backflow preventer, Residential: $90.

(3) 
Electrical subcode fee. The electrical subcode fee shall be determined as follows:
(a) 
Receptacles: $5 per device.

Receptacles include, but are not limited to, lighting outlets, wall switches, lighting fixtures, fluorescent fixtures, detectors, light poles, emergency and exit lights, communication points, alarm devices/FAC panels and motors of less than one horsepower (hp) and other similar devices or devices of less than one kilowatt (kw).
(b) 
Motors and electrical devices.

[2] 
Greater than 10 horsepower to 50 horsepower: $150.

(4) 
Fire protection subcode fees. The fees for the fire protection subcode shall be as follows:
(a) 
For gas or oil heating system installations or conversions in private residences: $90 in commercial buildings: $200.
(b) 
For gas or oil heating systems installation or conversion in all other structures, per unit: $90.
(c) 
For the installation of any supplemental heating appliance which utilizes solid fuel such as wood or coal: $90. Any such appliance shall be vented into its own single-flue chimney.
(d) 
For installation of a fuel storage tank for a residential building: $90.
(e) 
Fuel oil or gasoline storage tanks:

For installation of fuel oil gasoline storage tanks in connection with a commercial or business building:
[a] 
Each tank up to 1,000 gallons capacity: $200.
[b] 
Each tank 1,001 gallons to 3,000 gallons capacity: $300.
[c] 
Each tank in excess of 3,000 gallons capacity: $400.

When installed with oil-burning equipment, the fee for installation of the tank shall include the fee for the installation of the oil-burning equipment.
(f) 
For installation of sprinkler systems, control valves, flow switch and Fire Department connections, the fee shall be computed on the number of devices to be installed.

Twenty-six to 75 heads: $200.
[3] 
Seventy-six to 100 heads: $250.

(g) 
For fire-suppression systems such as dry chemicals, carbon dioxide, halon or foam systems:

Smoke detectors, heat detectors and carbon monoxide detectors. For installation of smoke detectors, heat detectors and carbon monoxide detectors: $10 for each detector/device.

Kitchen hood exhaust system (commercial): $200.
(k) 
Commercial chimney liner: $200.
(l) 
Installation of fireplaces utilizing gas, per unit: $90.

(5) 
Miscellaneous.
(a) 
The fee for a construction permit for any item requiring a Uniform Construction Code permit not specifically addressed shall be as follows unless otherwise specifically set by other subcode or municipal ordinance:

Residential: $100.
[2] 
Commercial: $200.
(b) 
For the reactivation for any permit that has become abandoned, the current fee schedule shall apply.
(c) 
Temporary tents/party tents, over 900 square feet or 30 feet of length in one direction:

Building fee: $100 residential; $200 commercial.
[2] 
Electrical fee: $100 residential; $200 commercial.
[3] 
Plumbing fee: $100 residential; $200 commercial.
[4] 
Fire protection fee: $100 residential; $200 commercial.
(d) 
Change of contractor processing/administrative fee: The fee to apply for a change of contractor of each building, plumbing, electrical and fire protection job shall be $90 plus any additional items/cost.
(e) 
Variation: The fee to apply for a building, plumbing, electrical or fire protection variation shall be $150 per discipline.
B. 
Plan review fee. The fee for plan review shall be 20% of the amount to be charged for the construction permit and shall be paid before plans are reviewed. The amount paid for this fee shall be credited toward the amount of the fee charged for the construction permit but shall not be refundable. The minimum fee shall be $100 for residential and $200 for commercial. For the purpose of determining estimated cost, the applicant shall submit to the Building Department, if available, cost date produced by the architect or engineer of record, by a recognized estimating firm or by the contractor. A bona fide contractor’s bid may also be submitted if available. The Construction Official shall make the final decision regarding estimated cost.
C. 
Demolition fee. The fee for a permit for demolition of:
(1) 
A one- or two-family residence: $350; commercial buildings: $450.
(2) 
Buildings or structures accessory to a one- or two-family dwelling: $200; commercial fee: $300.
D. 
Removal of fuel storage tanks.
(1) 
Residential. The fee for a permit for the removal of a residential fuel storage tank: $100.
(2) 
Commercial. The fee for a permit for the removal of a nonresidential fuel storage tank: $200.
E. 
Certificate of occupancy fees.
(1) 
All new construction, residential and commercial: $1,000.
(2) 
New construction for additions: residential, $400; commercial, $600.
(3) 
Accessory structure: residential, $100; commercial, $200.
(4) 
Other. For a certificate of continued occupancy, a certificate of occupancy pursuant to a change in use, multiple certificate of occupancy and similar conditions: residential, $400; commercial $600.
(5) 
The initial issuance of a temporary certificate of occupancy shall be free; however, the fee for a renewal of a temporary certificate of occupancy shall be $30 for all structures, whether residential or commercial, including accessory structures.
F. 
Surcharge fee for new construction and alteration work.
(1) 
Collection for required programs. In order to provide for the training, certification and technical support programs required by the Uniform Construction Code Act and regulations, the enforcing agency shall collect, in addition to the fees specified above, the surcharge fee as per N.J.A.C. 5:23-4.19. The surcharge fee shall be remitted to the Bureau of Housing Inspection, Department of Community Affairs, on a quarterly basis for the fiscal quarter ending September 30, December 31, March 31, and June 30 and not later than one month next succeeding the end of the quarter for which it is due. In the fiscal years in which the regulations first become effective, such fee shall be collected and remitted for the third and fourth quarters only.
(2) 
Annual report to Bureau of Housing Inspection. The enforcing agency shall report annually at the end of each fiscal year to the Bureau of Housing Inspection, and not later than July 31, the total amount of the surcharge fee collected in the fiscal year. In the fiscal year in which the regulations first become effective, such report shall be for the third and fourth quarter only.
G. 
Asbestos removal. The fee for asbestos removal should be as set forth in the Uniform Construction Code.

A. 
Fee schedule recommendation. The Construction Official shall, with the advice of the subcode officials, prepare and submit to the Mayor and Council annually a report recommending a fee schedule based on the operating expenses of the agency, and any other expenses of the Borough fairly attributable to the enforcement of the State Uniform Construction Code Act.
B. 
Fire zone delineation. The Construction Official shall prepare and submit to the Mayor and Council annually a report reevaluating the delineation of the fire zones. This report shall indicate the recommendations of the Construction Official, the Building Subcode Official and the Fire Subcode Official regarding those areas which should be designated as within fire zones, with the reasons therefor.
