Editor's Note: The preamble and § 1
of an ordinance adopted 9-11-1978 stated the following:
"WHEREAS, the Zoning Ordinance of the Borough
of Andover was enacted on August 9, 1971 and has been amended on various
occasions thereafter including readoption as an interim ordinance
on February 11, 1977, and
"WHEREAS, the provisions of the Municipal
Land Use Law of 1975, L. 1975. c 291, requires a Zoning Ordinance
to be based upon at least the land use element of a Master Plan adopted
pursuant to the provisions of N.J.S.A. 40:55D-28; and
"WHEREAS, N.J.S.A. 40:55D-90b provides for
the adoption of an interim Zoning Ordinance not related to the land
use plan element of the Master Plan, pending the adoption of a new
or substantially revised Master Plan, which interim ordinance shall
not be valid for a period longer than one year unless extended by
ordinance for a period no longer than an additional year for good
cause; and
"WHEREAS, the land use element of a Master
Plan has been prepared by the Borough of Andover Planning Board and
adopted on October 3, 1977, thus obviating the need for the Zoning
Ordinance to be on an interim basis, and
"WHEREAS, Chapter 115 of the Laws of 1976 permits the readoption of the Zoning Ordinance by reference without inclusion of the text or map thereof and in accordance with said act three copies of the text and maps of the Zoning Ordinance and of this ordinance effectuating the amendment and readoption thereof are on file in the office of the Municipal Clerk and are available for public inspection.
"NOW THEREFORE BE IT ORDAINED by the Borough
Council of the Borough of Andover as follows:
"Section 1 Except as amended hereinafter,
the ordinance known as the Zoning Ordinance of the Borough of Andover
shall be and is hereby readopted as it existed prior to the adoption
of the ordinance declaring said Zoning Ordinance to be on an interim
basis"
