A.
The Township of Freehold, Borough of Freehold, Borough
of Farmingdale, Township of Howell and Township of Wall have by parallel ordinances
heretofore duly adopted and published, created a public body corporate and
politic under the name and style of the "Manasquan River Regional Sewerage
Authority," hereinafter sometimes called the authority, pursuant to the provisions
of N.J.S.A. 40:14A-1 et seq., as amended and supplemented.
B.
For the purpose and relief of the waters in or bordering
upon the state of pollution arising from causes within the area of the municipalities
and the relief of waters in, bordering or entering said area from pollution
or threatened pollution and the consequent improvement of conditions affecting
the public health, and to provide for a collective approach solving the sewerage
and pollution problems of the area of said municipalities, the Authority has
undertaken the construction or acquisition of new and existing sewerage system
in the Borough of Freehold, Township of Freehold and the Township of Howell.
C.
The authority and the municipalities desire to go forward
with the Phase I Project to provide sewerage treatments and facilities in
the Township of Howell, Township of Freehold and Borough of Freehold as set
forth in a Map prepared by Elson T. Killam Associates, Inc., dated May, 1974,
described as "Proposed Phase I, Regional Facilities Interim Plan."
D.
Pursuant to N.J.S.A. 40:14A-1 et seq., an agreement with
the authority for the treatment and disposal of sewage from and arising in
the Township of Freehold has been submitted to the Township Committee for
consideration and approval.
The Township of Freehold in the County of Monmouth shall enter into
an agreement with the Manasquan River Regional Sewerage Authority and the
Borough of Freehold and the Township of Howell in the Authority Phase I Project
area, providing for and relating to the treatment and disposal on the terms
and conditions set forth in an agreement entitled "Proposed Phase I Regional
Facilities Interim Plan," and the Mayor shall be authorized and directed on
behalf of the Township Committee to execute such contract under the corporate
Seal of the municipality which shall be affixed and attested by the Clerk,
and to deliver the same.
Three copies of the agreement are on file in the office of the Township
Clerk and are available for public inspection, and the terms and conditions
thereof are hereby approved and specifically agreed to.
A.
The Township of Freehold (the "Township") and the Manasquan
River Regional Sewerage Authority (the "Authority") have heretofore entered
into a service agreement pursuant to an ordinance of the Township finally
adopted on July 23, 1979, as amended August 27, 1979, and April 14, 1980;
and the Township and the Authority agree that because the wastewater of the
Township will be collected and conveyed by the Authority to the Ocean County
Utilities Authority for treatment, an addendum to the service agreement is
necessary.
B.
The addendum to the service agreement between the Township
and the Authority is hereby adopted and authorized to be executed by the Clerk
of the Township and incorporated as part of the service agreement. A copy
of the service agreement and addendum is on file with the Township Clerk and
is available for public inspection.
C.
The service agreement, as revised by this addendum, remains
in full force and effect and is binding on the Township and the Authority.

That certain agreement heretofore entered into by the Township of Freehold
with the Western Monmouth Utilities Authority, an authority created in the
Township of Manalapan and Marlboro, in the County of Monmouth, pursuant to
the conditions of the Municipal Utilities Authorities Law N.J.S.A. 40:14B-1
et seq., on file in the office of the Township Clerk and heretofore executed
by the Mayor and Township Clerk on behalf of the Township and the Chairman
and Secretary of the Western Monmouth Utilities Authority on behalf of the
Authority, be and the same is hereby confirmed and ratified in all respects.
The agreement, executed and delivered on May 23, 1974, as between the
Township and the Authority is hereby incorporated herein by reference as though
set forth at length.
