Charges for sewerage service shall be made quarterly
on an as-used basis.
A.
Veterans or spouses of veterans who are qualified
for property tax relief pursuant to N.J.S.A. 54:4-8.10 et seq. and
senior citizens, disabled persons or surviving spouses of same who
are qualified for property tax relief pursuant to N.J.S.A. 54:4-8.40
et seq. are granted a discount of 10% on current bills paid on or
before the due date. All arrears must be paid in full before the current
bills will be accepted and discount allowed. The failure of the customer
to receive the bill does not entitle the customer to the discount
allowance if the bill becomes delinquent.[1]

Upon the effective dates of this article, a
copy thereof certified by the City Clerk shall be filed in the office
of the Clerk of Mercer County and shall be deemed notice to all owners
of real estate services by the City of Trenton Sewer Utility of their
liability for sewerage service supplied.
The sewer user charges shall be determined in
the following manner:

The minimum charge for each customer will be $20 per
quarter, regardless of usage.

D.
Equitable surcharges shall be developed for application to those wastes containing average suspended solids concentrations in excess of 200 mg/liter and average five-day BOD concentrations in excess of 200 mg/liter. The surcharges will reflect the part of capital and operating costs allocable to concentrations of suspended solids and five-day BOD above the limits defined in Subsection C.
E.
The total annual amount of water supplied to, or otherwise
obtained by, users of the sewer system shall be determined, and any
water that can be positively measured as being incorporated in a product,
such as a beverage, or used otherwise and not returned to the sewer
system for delivery to the sewage treatment plant shall be subtracted
from that total. The amount of water so determined shall be used as
the basis to determine flow charges.
F.
The total annual amount of five-day BOD received at
the sewage treatment plant shall be calculated and used as the basis
to determine surcharges for excessive five-day BOD concentrations.
G.
The total annual amount of suspended solids received
at the sewage treatment plant shall be calculated and used as the
basis to determine surcharges for excessive suspended solids concentrations.
H.
The amount of water determined under Subsection D shall be divided into the annual amount of water supplied to or otherwise obtained by customers.
I.
The total annual pounds of five-day BOD, against which
a surcharge shall be applied, shall be determined as the number of
pounds in those wastes having average concentration in excess of 200
mg/liter that is in excess of that concentration.
J.
The total annual pounds of suspended solids against
which a surcharge shall be applied shall be determined as the number
of pounds in those wastes having average concentrations in excess
of 200 mg/liter that is in excess of that concentration.
K.
The respective charges to industrial customers for excessive strength discharges of five-day BOD and suspended solids shall be determined by multiplying the number of pounds contributed by each user determined under Subsections I and J above, respectively, by the appropriate unit cost obtained by dividing the total cost allocable to treatment of five-day BOD by the total pounds of five-day BOD received at the treatment plant, and the total cost allocable to treatment of suspended solids by the total pounds of suspended solids received at the treatment plant.
L.
The total annual costs shall be estimated for each
year for five years into the future and shall be computed as the sum
of the annual debt service, and the annual costs for operating and
maintaining the sewer utility at the level of performance for which
it is designed. Estimates of costs shall allow for inflation at an
appropriate annual rate.
M.
N.
To total estimated revenue derived from charges under Subsections K and L for excessive concentrations of five-day BOD and suspended solids shall be subtracted from the total cost computed under Subsection L for determination of the minimum charge and unit charge described under Subsections A and B.
O.
The minimum charge shall be determined by dividing the quantity of water obtained under § 309-48 by the total quantity of water under Subsection E and multiplying that number by the cost determined under Subsection N, to obtain the total cost to be applied to the minimum charge, and dividing that number by the total number of customers served and multiplying that number by 1.10.
The user charge system shall be reviewed no
less frequently than biannually to insure sufficient funds are derived
from this system for operation and maintenance of the sewer utility
at the level of performance for which it is designed.
