A.Â
Double parking. Except when necessary to avoid conflict
with other traffic, or when in compliance with law or the directions
of a police officer or official traffic control device, no person
shall stop, stand or park a vehicle on the roadway side of any vehicle
stopped, standing or parked at the edge or curb of a street.
B.Â
Parking on crosswalk. Except when necessary to avoid
conflict with other traffic, or when in compliance with law or the
directions of a police officer or official traffic control device,
no person shall stop, stand or park a vehicle on a crosswalk.
C.Â
Blocking driveway. Except when necessary to avoid
conflict with other traffic, or when in compliance with law or the
directions of a police officer or official traffic control device,
no person shall stand or park a vehicle, whether occupied or not,
except momentarily to pick up or discharge a passenger or passengers,
in front of a public or private driveway.
D.Â
Within 20 feet of intersection. Except when necessary
to avoid conflict with other traffic, or when in compliance with law
or the directions of a police officer or official traffic control
device, no person shall stand or park a vehicle, whether occupied
or not, except momentarily to pick up or discharge a passenger or
passengers, within 20 feet of a crosswalk at an intersection, unless
a different distance is indicated by official signs, markings or parking
meters.
E.Â
Within 30 feet of traffic control device. Except when
necessary to avoid conflict with other traffic, or when in compliance
with law or the directions of a police officer or official traffic
control device, no person shall stand or park a vehicle, whether occupied
or not, except momentarily to pick up or discharge a passenger or
passengers, within 30 feet upon the approach to any flashing signal,
stop or yield sign or traffic control signal located at the side of
the roadway, unless a different distance is indicated by official
signs, markings or parking meters.
F.Â
Within 15 feet of fire hydrant. No person shall stop,
stand or park a vehicle within 15 feet of a fire hydrant, except when
such vehicle is attended by a licensed operator or chauffeur who is
seated in the front seat and who can immediately move such vehicle
in case of emergency, unless a different distance is indicated by
official signs, markings or parking meters.
G.Â
Improper parking. Except where angle parking is authorized,
every vehicle stopped, standing or parked partly upon a roadway shall
be so stopped, standing or parked parallel to the curb or edge of
the roadway. On a one-way roadway, such vehicle shall be facing in
the direction of authorized traffic movement; on a two-way roadway,
such vehicle shall be facing in the direction of authorized traffic
movement on that portion of the roadway on which the vehicle rests.
H.Â
Left side to curb. Except where angle parking is authorized,
every vehicle stopped, standing or parked wholly upon a one-way roadway
shall be so stopped, standing or parked parallel to the curb or edge
of the roadway, in the direction of authorized traffic movement, with
its right-hand wheels within 12 inches of the right-hand curb or edge
of the roadway, or its left-hand wheels within 12 inches of the left-hand
curb or edge of the roadway.
I.Â
Twelve inches from curb. Except where angle parking
is authorized, every vehicle stopped, standing or parked wholly upon
a one-way roadway shall be so stopped, standing or parked parallel
to the curb or edge of the roadway, in the direction of authorized
traffic movement, with its right-hand wheels within 12 inches of the
right-hand curb or edge of the roadway, or its left-hand wheels within
12 inches of the left-hand curb or edge of the roadway.
J.Â
Key in ignition. No person driving or in charge of
a motor vehicle shall permit it to stand unattended without first
stopping the engine, locking the ignition, removing the key from the
vehicle and effectively setting the brake thereon and, when standing
upon any grade turning the front wheels to the curb or side of the
highway; provided, however, that the provision for removing the key
from the vehicle shall not require the removal of keys hidden from
sight about the vehicle for convenience or emergency.
K.Â
Abandoned vehicle. A motor vehicle shall be deemed
to be an abandoned vehicle if left unattended:
(1)Â
With no number plates affixed thereto, for more than
six hours on any highway or other public place.
(2)Â
For more than 24 hours on any highway or other public
place, except a portion of a highway or public place on which parking
is legally permitted.
(3)Â
For more than 48 hours, after the parking of such
vehicle shall have become illegal, if left on a portion of a highway
or public place on which parking is legally permitted.
L.Â
Parking on sidewalk. No person shall drive a motor
vehicle on or across a sidewalk, except that a vehicle may be driven
at a reasonable speed, but not more than five miles per hour, on or
across a sidewalk in such manner as not to interfere with the safety
and passage of pedestrians thereon, who shall have the right-of-way,
when it is reasonable and necessary:
(1)Â
To gain access to a public highway, private way or
lands or buildings adjacent to such highway or way.
(2)Â
In the conduct of work upon a highway, or upon a private
way or lands or buildings adjacent to such highway or way.
(3)Â
To plow snow or perform any other public service,
for hire or otherwise, which could not otherwise be reasonably and
properly performed.
M.Â
Parking in fire lanes. No person shall stop, stand
or park a vehicle adjacent to or along any curb or sidewalk wherever
a fire lane has been designated by either yellow striping or the posting
of a "No Parking — Fire Lane" sign.
N.Â
Parking commercial vehicles on public streets overnight. No person shall park a vehicle displaying a commercial license plate or commercial vehicle registration at any time between 12:00 midnight and 6:00 a.m. on any public street located in a residential zoning district as described and contained in Chapter 263, Zoning, of the municipal Code of the Village of Brewster and the official Zoning Map which is part thereof.
O.Â
Parking in front yards. No person shall cause a motor
vehicle, as that is defined by the New York State Vehicle and Traffic
Law (VTL), to stop, stand or park on other than a driveway between
the curblines or the lateral lines of a street or highway on property
of a single- or multiple-family dwelling within the Village of Brewster,
New York.

Parking in temporary no-parking zone. No person shall park a motor
vehicle in any zone designated as a temporary no-parking zone by a
duly adopted resolution of the Village Board of Trustees.

A.Â
Whenever any police officer or code enforcement officer finds a vehicle standing upon a highway in violation of § 250-30 of the Village Code, or at any place where stopping, standing or parking is prohibited, such officer is authorized to cause such vehicle to be removed from the location to a garage, automobile impound lot or other place of safety, or shall require the driver or other person in charge of the vehicle to remove the vehicle from the location.
B.Â
Whenever any police officer, code enforcement officer or Superintendent of Public Works finds a vehicle parked in violation of § 250-20 of the Village Code, such officer or Superintendent is authorized to provide for the removal of such vehicle to a garage, automobile impound lot or other place of safety, or shall require the driver or other person in charge of the vehicle to remove the vehicle from the location.
C.Â
The owner or other person lawfully entitled to the possession of
a vehicle that is removed and stored pursuant to the provisions of
this section may be charged with a reasonable cost of the removal
and storage of the vehicle, which shall be paid by the owner prior
to the release of the vehicle to the owner. A vehicle that is removed
and stored pursuant to the provisions of this section shall not be
released to the owner until all required fees and costs related to
the removal and storage of the vehicle are paid, in addition to any
and all fines incurred by the owner in connection with the violation
that resulted in the removal and storage of the vehicle. In addition
to the aforementioned payment by the owner, a vehicle that is removed
and stored pursuant to the provisions of this section shall not be
released to the owner unless the owner presents proof of ownership
of the vehicle, a valid registration and valid proof of insurance
for the vehicle.
D.Â
Storage fees shall be charged at a rate approved by the Village Board
of Trustees plus the actual cost incurred by the Village of Brewster
for the removal of the vehicle.
A.Â
In addition to members of the Putnam County Sheriff's
Department, any member of the Village of Brewster Parking Enforcement
Officers, any Brewster police officer and any Code Enforcement Officer
are authorized to issue a parking summons to a party found to be in
violation of any statute, rule, regulation or ordinance pertaining
to parking, which is contained in the Village of Brewster.

B.Â
The parking summons shall be in a form acceptable
to the Village of Brewster Board of Trustees, the Village Attorney
and Village Justice Court.
A.Â
Any person who violates the parking provisions of
this chapter and the New York Vehicle and Traffic Law (VTL), as listed
below, shall be subject to a fine schedule as established by resolution
of the Village of Brewster Board of Trustees. Such fine schedule may
thereafter be amended from time to time by like resolution. The fine
schedule will be on file with the Clerk of the Village of Brewster.

C.Â
The penalty schedule for parking violations shall
be structured for failure to answer a parking summons as follows:
(1)Â
At 15 calendar days after the date of the summons,
the fine is doubled.
(2)Â
At 60 days after the date of the summons, the fine
is tripled.
