This chapter shall be known as the "Water Code of the Village of Brewster."
A. 
It is the intent of the Village of Brewster to continue to furnish an adequate supply of potable water to the residences and business establishments in the Village of Brewster and also to supply sufficient water with sufficient pressure in its water distribution system to adequately protect the buildings in the Village from damage or destruction by fire and to permit the residents of the Village to have the protected rate of the fire rating organizations on their fire insurance for both their buildings and personal property.
B. 
This chapter is therefore enacted in order that the water distribution system may be properly maintained, improved and extended primarily for the benefit of the water owners and taxpayers within the Village limits.
This chapter shall be applicable to all property and water owners within the Village of Brewster. Additionally, this chapter shall be applicable to all Town of Southeast water districts or outside consumers receiving water via the water distribution system as defined herein.
The rules and regulations set forth in this chapter shall be considered a part of the contract of any property owner who obtains water from the water distribution system, and every such owner shall be considered as having expressed consent to be bound thereby. Any and all outside consumers, as defined herein, prior to receiving water from the water distribution system, or to continue to receive water from the water distribution system if they are connected to water distribution system at the time of the enactment of this chapter, shall sign a document in the form approved by the Board of Trustees, acknowledging that they are bound by the terms of this chapter.
In accordance with § 10 of the Municipal Home Rule Law of the State of New York, the Board of Trustees of the Village of Brewster, New York has the authority to enact local laws and amend local laws for the purpose of promoting the health, safety or general welfare of the Village of Brewster, New York and for the protection and enhancement of its physical environment. The Board of Trustees may include in any such local law provisions for the appointment of any municipal officer, employees, or independent contractor to effectuate, administer and enforce such local law.
As used in this chapter, the following terms shall have the meanings indicated:
BOARD OF TRUSTEES
The Board of Trustees of the Village of Brewster, New York.
BOARD OF WATER COMMISSIONERS
The Village of Brewster Board of Trustees.
OUTSIDE CONSUMER
The person or entity that is the owner of the premises located outside of the corporate limits of the Village of Brewster connected with the water distribution system.
OWNER
The person or entity that is the owner of the premises located within the corporate limits of the Village of Brewster connected with the water distribution system.
SUPERINTENDENT
The superintendent duly designated by the Board of Trustees to supervise the operation of a water distribution system within the Village of Brewster, which may also supply water to outside consumers in accordance herewith.
VILLAGE OF BREWSTER or VILLAGE
The Village of Brewster, a municipal corporation located in the Village of Brewster, Putnam County New York.
WATER DISTRIBUTION SYSTEM
The network of water mains, service lines, hydrants and related appurtenances located solely within the corporate limits of the Village of Brewster, through which the water is supplied by the Village of Brewster to the premises of the owners and to Town of Southeast water districts or outside consumers, as defined herein.
WATER DISTRICT OR DISTRICTS
Any water districts established in accordance with law, which are serviced by the water distribution system outside the limits of the Village of Brewster.
WATER OPERATOR
Any employee or designee, under the supervision of the Superintendent, assigned to repair or maintain the water distribution system.
The Superintendent of Public Works shall be the Superintendent in charge of the water distribution system of the Village of Brewster, subject to the control and supervision of the Board of Trustees of the Village of Brewster.
The Superintendent shall administer, implement and enforce the provisions of this chapter. In addition, this chapter shall be enforced by any official authorized to issue and serve appearance tickets under Chapter 4, Appearance Tickets, of the Code of the Village of Brewster or the laws of the State of New York.
