A. 
The provisions of this chapter shall apply to every person or persons owning property or residing or doing business within the limits of Garden City.
B. 
The collection and disposal of refuse shall be under the supervision of the Director of Public Works, who shall have authority to make or modify, from time to time, such regulations pertaining to the collection and disposal of refuse as may be deemed advisable in the public interest, provided such regulations are not contrary to the intent of this chapter.

As used in this chapter, the following terms shall have the meanings indicated:
ASHES
The residue from fires used for cooking and for heating buildings.
COMBUSTIBLE RUBBISH
Tree branches, leaves, grass and hedge clippings and similar garden refuse, wood and any combustible household refuse not otherwise classified.
GARBAGE
Waste from the preparation, cooking and consumption of foods; market refuse; waste from the handling, storage and sale of produce; paper, cartons and wooden boxes and barrels; empty glass bottles; small tin cans, rags and miscellaneous combustible household trash.
NONCOMBUSTIBLE RUBBISH
Furniture, bedding, metals, crockery, small stones, dirt and other mineral refuse.
Garbage, ashes, combustible rubbish and noncombustible rubbish shall each be placed and maintained in separate receptacles or as hereinafter provided.

A. 
All kitchen food refuse shall be drained of surplus liquid and shall be securely wrapped in paper and deposited promptly in approved garbage containers.
B. 
Newspapers and magazines shall be securely tied in bundles not heavier than 40 pounds nor more than four feet in length and 18 inches in diameter.
C. 
Leaves, grass clippings, similar garden refuse, dirt and small stones shall be placed in approved rubbish containers, except that leaves may be placed on the street during periods prescribed in the months of October and November for leaf collection by the village leaf-removal equipment.
A. 
Garbage containers shall be of metal, watertight, with tight-fitting covers and equipped with bails or handles for easy handling.
B. 
Ash containers shall be of metal, of sturdy construction, with adequate handles for handling and to prevent spillage.
C. 
Rubbish containers shall be of a type suitable for the material therein deposited. Such containers should preferably be of wood or metal, but baskets, burlap or cloth bags and substantial cartons may be used for light rubbish such as leaves, etc. Rubbish that cannot readily be placed in containers shall be reduced in volume as much as possible and securely tied to permit safe and speedy handling.
D. 
The combined weight of any container and its contents shall not exceed 40 pounds.

E. 
Containers shall be maintained clean and in good condition. Any container that does not conform to the provisions of this chapter or that may have ragged or sharp edges or any other defect liable to hamper or injure the person collecting the contents thereof must be promptly replaced by a proper receptacle upon receipt of notice to that effect from the Director of Public Works, and if not so replaced within 10 days after the receipt of such notice, such nonconforming or defective container may be collected and disposed of as waste.

F. 
An adequate number of containers shall be provided for each of the several classes of refuse, as herein defined, to properly store such refuse until the regularly scheduled collection time.

A. 
Containers with garbage should be placed at the rear of the premises and shall not be kept or placed upon the street, sidewalk, other public place nor upon the front yard of the premises.
B. 
Containers with rubbish shall be placed at the curb or near the front property line of the premises, preferably near the driveway entrance, or at such other location as may specifically be approved by the Department of Public Works, before 7:30 a.m. on the designated collection day but not earlier than 12 hours prior thereto, and shall not be placed upon the street or sidewalk. After collection, empty rubbish containers shall be promptly removed from the collection point.

Collection of the several classes of refuse, as herein defined, shall be made with such frequency and on such days and at such hours as may from time to time be established by the Director of Public Works.
A. 
The Department of Public Works will under no conditions collect any of the following-described materials:
(1) 
Solid or liquid waste resulting from industrial processes and manufacturing operations, such as food-processing wastes, boiler house cinders, lumber scraps and shavings, metal scraps and shavings, waste oil and grease, etc.
(2) 
Wearing apparel, bedding or other refuse from homes or other places where highly infectious or contagious diseases have prevailed.
(3) 
Offal, meats, fruits, vegetable and food products that are unsalable or which have been condemned by health authorities.
(4) 
Abandoned automobiles.
(5) 
Swill and slops or garbage containing free liquids.
(6) 
Building rubbish or waste material from the construction, remodeling and repair operations on houses, commercial buildings and other structures, including, among other rejected matter, excavated earth, stones, bricks, plaster, wallpaper, lumber, shingles, concrete and waste parts from plumbing, heating and electrical work and roofing.
(7) 
Rubbish from other contract operations on the premises.
B. 
The transportation and disposal of all such prohibited material shall be the responsibility of the owner or occupant of the premises, subject to such regulations as may be from time to time promulgated by the Director of Public Works.

C. 
The Department of Public Works will also not accept for collection refuse material which is not prepared, stored or placed for collection in accordance with the provisions of this chapter, including but not limited to material not properly segregated, material in unsafe, inadequate or overloaded containers, material not placed at the designated collection point, leaves and grass not in containers, except as provided in § 115-4 of this chapter.
D. 
Under no conditions shall there be placed in any material intended for collection any gasoline, benzine, kerosene, turpentine, paint or similar explosive or highly volatile liquids, nor any cartridges, shells, ammunition, gunpowder or explosives of any kind.
E. 
Under no condition shall there be placed in any garbage or rubbish container any broken glass, metal with jagged or sharp edges or other material liable to injure the collector, unless properly packaged.
A. 
The Department of Public Works will collect normal amounts of all classes of refuse from the premises, but where abnormal amounts are placed for collection, the Department reserves the right to refuse the material, to defer the collection, to collect the material in part or to make a special collection thereof at charges herein provided, as may be desirable in the public interest.
B. 
Combustible and noncombustible rubbish shall be placed in containers, and the combined weight of any container and its contents shall not exceed 40 pounds.

C. 
Dead animals will only be collected by special collection at charges herein provided.
D. 
Trees, tree branches, large bushes, logs, etc., not reduced to size or bundled as provided in § 115-4, will only be collected by special collection at charges herein provided, and then only when the material can be readily loaded on collection vehicles by two men.
E. 
Other materials not specifically provided for herein may, on application to the Department of Public Works, be accepted in its discretion for special collection at charges herein provided.
A. 
The Director of Public Works is authorized to establish charges for special collections, based on the personnel and equipment required therefor plus a reasonable overhead, but in no event less than $5 per hour.

B. 
Such special collection service shall be rendered only at the convenience of the Department of Public Works' subject to the availability of personnel and equipment, and without liability for delay.
A. 
The facilities of the municipal incinerator and dump will be available for the disposal of refuse herein designated as prohibited material, except swill, slops and offal. Such refuse shall be segregated as to combustible and non-combustible, shall be delivered during working hours only and shall be unloaded or dumped at such locations and in such manner as may be directed. The Director of Public Works shall have the rights however, to further regulate, restrict or prohibit the use of the municipal incinerator or dump, as may be necessary in the public interest or due to operating conditions thereat or for repeated violations of regulations.

B. 
No swill, slops and offal shall be disposed of within the village limits.
A. 
All refuse collected by the Village shall be the property of the Village. Neither the Village nor its agents nor employees shall be responsible for the collection or disposal of material not intended for collection but placed in error with the garbage, ashes or rubbish.
B. 
The Village will not be responsible for failure to render collection services to premises where conditions prevent safe, easy and ready access.

A. 
When discarded newspapers are placed near the front property line of premises in the village for collection, such newspapers shall become the property of the Village.
B. 
No person, other than the owner, lessee or occupant of the property at which the collection is made, or an employee or agent of the village acting under the supervision of the Department of Public Works, shall remove or cause to be removed such newspapers placed at or near the front property line for collection.

The Board of Trustees may, from time to time, by resolution, establish fees for special sanitation removal for commercial establishments which have an excess accumulation of waste. An excess accumulation of waste is defined as collection of more than one 1 1/2 cubic yard container (dumpster) or 10 thirty-gallon acceptable waste containers or bags per week.

All unpaid charges or fees for special collections or special sanitation removal imposed on or after June 1, 2009, including any penalties or interest not paid by May 20 of each year, may be assessed against the benefitted properties and be added to the Village tax roll. Upon being transferred to the tax roll, an administrative charge in the amount of 10% of the outstanding unpaid amount shall be added.
