The Department of Community Development is hereby established and created and shall be under the direction and control of a Community Development Authority as established under Chapter 327 of the Acts of 1979, a Special Act of the Massachusetts Legislature, adopted June 25, 1979.
A. 
The Department of Community Development shall carry out all the duties and powers imposed and conferred upon the Community Development Authority by the Massachusetts General Laws, ordinances and any special legislation upon city planners, redevelopment authority chairmen and executive directors, housing authority chairmen and executive directors and community development grant administrators. The powers of the Department, while not expressly limited to, shall include the following powers subject to the limitations provided in the act to:
(1) 
Conduct investigations, make studies, surveys and plans and disseminate information relative to community development, including desirable patterns for land use and community growth, urban renewal, public housing, relocation and any other matter deemed by it to be material in connection with any of its powers and duties and to make such studies, plans and information available to the federal government, to agencies and subdivisions of the commonwealth and to interested persons.
(2) 
Develop, test and report on methods and techniques and pilot projects relative to community development.
(3) 
Provide to the City Auditor the data necessary to compute and the actual computation of relocation payments due to persons and businesses displaced as a result of carrying out any such project.
(4) 
Make studies and conduct investigations related to community development for all City departments which have or project capital expenditures or which contribute to the physical development of the City.
(5) 
Compile, analyze and interpret data pertaining to municipal planning; initiate and conduct studies of the resources, possibilities and needs of the City; prepare plans and drafts of recommendations for:
(a) 
Use of land for residential, commercial, industrial, recreational and other purposes; control of shifts of population; situating public and private ways, bridges, parks, recreation facilities, public buildings, public utility services, public garages and off-street parking facilities; and affording further facilities for the housing, transportation, employment, health, safety and general welfare of the population.
(b) 
Prepare and submit annually a long-range capital improvement program for the City, including data as to the cost of each project recommended, relative priorities of projects from the standpoint of urgency and desirability and the aid of loans, special revenues and trust funds, accumulated surplus and funds obtained from the annual tax levy, together with the estimated amounts returnable to the City by betterment assessments.
B. 
The Department shall be responsible for federal funds coordination; the administration of all community development grants by whatever title; capital improvements and programming; land use, zoning, environmental and long-range physical planning; residential, industrial and commercial development planning and financing, and social and human services planning.
C. 
This Department also would act as consultant, advisor, state and federal funding agent to the following boards, committees, commissions, authorities, agencies and boards:
(1) 
Citizens' Advisory Committee.
(2) 
Recreation Commission.
(3) 
Building and Code Enforcement Departments.
(4) 
Board of Health.
(5) 
Planning Board.
(6) 
Zoning Board of Appeal.
(7) 
Conservation Commission.
(8) 
Historical Commission.
(9) 
Industrial Finance Authority.
(10) 
Fort Meadow Commission.
(11) 
Fair Housing Committee.
(12) 
All human service agencies.
(13) 
Office of Cultural Affairs.
D. 
The Department shall provide any consultative or technical assistance required by the Mayor, City Council, City departments, boards and commissions.
A. 
There shall be a Director of Community Development appointed by the Mayor for an initial term of three years and subsequent terms of five years, subject to confirmation by the City Council.
B. 
The Director of Community Development shall be the supervisory and administrative head of the Department of Community Development.
C. 
The qualifications of the Director of Community Development shall be established by the Community Development Authority.[1]

The Marlborough Redevelopment Authority and the position of Executive Director of said Authority are hereby abolished, and its function and administrative staff, as set forth in Chapter 327 of the Acts of 1979, a Special Act of the Massachusetts Legislature, adopted June 25, 1979, shall be transferred to the Department of Community Development.
The Marlborough Housing Authority and the position of Executive Director are hereby abolished, and its function and administrative staff, as set forth in Chapter 327 of the Acts of 1979, a Special Act of the Massachusetts Legislature, adopted June 25, 1979, shall be transferred to the Department of Community Development.
There is a need for an economic development and industrial corporation because unemployment, or a threat thereof, exists in the City and security against future unemployment and lack of business opportunity is required, and attracting new industry into the municipality and substantially expanding existing industry through any economic development project or projects financed under Chapter 121C of the Annotated Laws of Massachusetts and implemented by such a corporation would alleviate the unemployment and lack of business opportunity problems. The City hereby accepts the provisions of Chapter 121C of the Annotated Laws of Massachusetts, which relate to the power of economic development and industrial corporations.
The Director and all officers and employees necessary to carry out the work of the Department of Community Development shall receive such annual salary as authorized by the Mayor with the approval of the City Council.
