A.
Schedule. There shall be paid to the Town Clerk at
the time an application is filed for any license under this chapter
a fee or fees as set forth by the Town Board from time to time.
B.
Refund. In case a license is not granted, 1/2 of the
license fee shall be refunded to the applicant. No other refunds shall
be granted.
C.
Quarterly fees for an amusement center and device
license shall be paid on a yearly basis and are to be paid at the
time of application.
A.
The Town Clerk may deny or revoke a license or deny
the renewal of a license to any applicant who has been convicted of
a crime or who does not comply with the provisions of this chapter
or any rules or regulations promulgated under this chapter or who
makes a material misrepresentation on the license application. The
Town Clerk shall give a written notification to an applicant of the
reasons for the denial or revocation of a license.
B.
The Monroe County Sheriff's Department or New York
State Police shall have the power to investigate and inquire into
licensees and applicants under this chapter and to require and enforce
by subpoena the attendance of witnesses at such investigations.
Any person aggrieved by the action of the Town
Clerk in the denial of an application for a license, as provided in
this chapter, shall have the right to appeal to Town Board of the
Town of Chili. Such appeal shall be taken by filing, within 14 days
after notice of the action complained of has been mailed to such person's
last known address, a written statement setting forth fully the grounds
for the appeal. The Town Board shall set a time and place for a hearing
on such appeal, and notice of such hearing shall be mailed to the
applicant at his or her last known address at least five days prior
to the date set for the hearing. The granting, refusal or revocation
of a license by the Town Board shall be subject to review by certiorari.
A.
Any offense against any provision of this chapter
shall be punishable by a fine of not more than $250.

B.
Each day an offense continues shall be deemed a separate
offense.
C.
In addition to the above penalties, the Town Board
may also maintain an action or proceeding in the name of the Town
in a court of competent jurisdiction to compel compliance with or
to restrain by injunction any offense against any provision of this
chapter.
