GENERAL REFERENCES
Uniform construction codes — See Ch. 210.
All electrical installations hereafter made
in the Town of Chili, including but not limited to the installation,
alteration or repair of wiring for electric lighting, heat or power
and signal systems, in or on real property shall be made in conformity
with the requirements of the New York State Uniform Fire Prevention
and Building Code, as such Code is now constituted or as from time
to time amended, except where the provisions of this chapter or any
other local law or ordinance of the Town or any state law, rule or
regulation shall have more stringent requirements, in which event
compliance with the more stringent provisions of such other local
law or ordinance, state law, rule or regulation shall be recognized
as proper compliance with this chapter.
The Chief Inspector and each of the duly appointed
inspectors of a Town-designated and licensed electrical inspection
agency are hereby authorized by the Town of Chili to make inspections
and reinspections of all electrical installations heretofore and hereafter
described and to approve or disapprove the same. In no event, however,
will the cost or expense of such inspections and reinspections be
a charge against the Town of Chili.

A.
No person or agency shall conduct electrical inspections
pursuant to applicable codes unless the person or agency undertaking
such inspections has obtained approval and license to inspect from
the Building Department.
B.
The annual licensing charge shall be a fee as set
by Town Board resolution and shall be paid at the time of application.
The license shall be issued by the Town Clerk upon approval of the
Building Department. Certain criteria shall be established by the
Town and revised from time to time and submitted by an applicant for
licensing, which criteria and completed criteria shall be met and
approved by the Town Building Department in each instance before licensing
and/or renewal. The Town shall be satisfied that said agency is competent
to conduct such inspections.

A.
The Town Code Enforcement Officer, at any time subsequent
to the issuance of a license, if he has reason to believe that the
agency no longer meets the standards for an electrical inspections
agency or is no longer competent to conduct electrical inspections,
shall, after a hearing, have the power to suspend or revoke the license.
B.
All licenses, unless sooner revoked, shall expire
on the last day of December in the calendar year it was issued, and
application for a new license shall be made in the same manner as
for the original license by the last day of December.
C.
The annual license fee shall be set by Town Board
resolution.
D.
The Town Code Enforcement Officer is hereby authorized
to adopt any standards, procedures, rules, regulations and forms that
are necessary to effectively administer and enforce this section.
A.
It shall be the duty of the Inspector to report, in
writing, to the Code Enforcement Officer, whose duty it shall be to
enforce all provisions of this chapter, all violations or deviations
of this chapter, all violations or deviations from or omissions of
the electrical provisions of the NEC Code and Uniform Fire Prevention
and Building Code.

B.
The Inspector shall make inspections and reinspections
of electrical installations in and on properties in the Town of Chili
upon the written request of an authorized official of the Town of
Chili or as herein provided. The Inspector is authorized to make inspections
and reinspections of electrical wiring, installations, devices, appliances
and equipment, in or on properties within the Town of Chili where
he deems it necessary for the protection of life and property. In
the event of an emergency, it is the duty of the Inspector to make
electrical inspections upon the oral request of an official or officer
of the Town of Chili.
C.
It shall be the duty of the Inspector to furnish written
reports to the proper officials of the Town of Chili and owners and/or
lessees of property where defective electrical installations and equipment
are found upon inspection.
D.
He shall authorize the issuing of a certificate of
compliance when electrical installations and equipment are in conformity
with this chapter. He shall direct that a copy of the certificate
of compliance be sent to the Town of Chili to the attention of the
Code Enforcement Officer.
The provisions of this chapter shall not apply
to electrical installations in mines, ships, railway cars and automotive
equipment, nor to the installations or equipment employed by a railway,
electrical or communication utility in the exercise of its function
as a utility and located outdoors or in buildings used exclusively
for that purpose. This chapter shall also not apply to any work involved
in the manufacture, assembly, testing or repair of electrical machinery,
apparatus, materials and equipment by a person, firm or corporation
engaged in electrical manufacturing as its principal business, nor
shall it apply to any building which is owned or leased in its entirety
by the government of the United States or the State of New York.
This chapter shall not be construed to relieve
or lessen the responsibility of any person owning, operating, controlling
or installing any electrical wiring, devices, appliances or equipment
for loss of life or damage to person or property caused by any defect
therein, nor shall the Town of Chili or the electrical inspectors
be deemed to have assumed any such liability by reason of any inspection
made pursuant to this chapter.
It shall be a violation of this chapter for
any person, firm or corporation to install or cause to be installed
or to alter or repair electrical wiring for light, heat or power,
in or on properties in the Town of Chili until a written application
for inspection has been filed with the Electrical Inspector. The said
Electrical Inspector shall forward to the Town Building Department
a record of all such applications received by it. It shall also be
a violation of this chapter for a person, firm or corporation to connect
or cause to be connected electrical wiring in or on properties for
light, heat or power to any source of electrical energy supply prior
to the issuance of a temporary certificate therefor by
the Electrical Inspector or the issuance of a permit for occupancy
by the Town Code Enforcement Officer. The Electrical Inspector shall
forward to the Town Building Department a record of all temporary
certificates issued by him.
A schedule of fees and charges must be set forth
in the application for licensing and shall be adhered to by the licensing
agency during the licensing period. Said fees, as set forth in the
criteria application, shall be deemed approved and authorized by the
Town at such time as the license is approved.

Violations of this chapter shall be punishable as violations of the Uniform Code, and the penalties set forth in § 210-19 of Article I, Administration and Enforcement, of Chapter 210, Construction Codes, Uniform, of the Code of the Town of Chili shall apply. Violations of this chapter may also result in a revocation of any licenses and/or permits issued hereunder.
