No person shall alter or disturb the drainage ditches, gutters or culverts of any Village street.
No person shall install drainage tile or drainage materials of any kind or description in the drainage ditches, gutters or culverts of any street or highway within the limits of the Village of Florida without first procuring a permit therefor from the Village Board.
Application for such permit shall be made in writing to the Village Clerk, shall be signed by the applicant and shall state the following:
A. 
General description of the location.
B. 
Purpose.
C. 
Detailed description of materials to be used.
D. 
That the applicant will retain responsibility for subsequent maintenance of materials used.
E. 
That the applicant will indemnify the Village for any damage resultant from injury to life, limb or property as a result thereof.
There shall be presented to the Village Clerk with such application the sum of $25 to be held as a guaranty for the proper performance of the purpose for which a permit is granted to the applicant.
The said $25 presented as a guaranty shall be returned to the applicant after inspection and approval of the complete installation hereunder by the Superintendent of Highways of the Village.
A separate application shall be made for each installation or replacement of drainage tile or other drainage material.

Every person who shall fail or neglect to obtain such permit or who shall violate any of the provisions of this article shall be subject to a penalty of not more than $250 or imprisonment for a term not exceeding 15 days, or both, for each and every offense.
Alterations to or installation or replacements of drainage tile or other drainage materials in the drainage ditches, gutters or culverts of any street or highway within the limits of the Village performed by the Highway Department of the Village shall be exempt from the provisions of this article.
