The following public highways in the Town of Plattekill
are designated as truck exclusion highways, upon which trucks and commercial
vehicles are prohibited to travel:
This section shall not be construed to prevent the delivery
or pickup of merchandise or other property along the highways from which such
vehicles are otherwise excluded.
Any person violating or causing to be violated any of
the provisions of this article or amendments thereto shall be deemed guilty
of a traffic infraction as defined by the Vehicle and Traffic Law of the State
of New York and, upon conviction, unless otherwise provided, shall be punished
as provided for in the Vehicle and Traffic Law of the State of New York § 1800(b).
Unless otherwise noted within this article, every person
convicted of a traffic infraction for a violation of any provision of this
article which is not a violation of any provision of the Vehicle and Traffic
Law of the State of New York shall, for a first conviction thereof, be punished
by a fine of not more than $50 or by imprisonment for not more than 15 days,
or by both such fine and imprisonment; for a second conviction within 18 months
thereafter, such person shall be punished by a fine of not more than $100
or by imprisonment for not more than 45 days, or by both such fine and imprisonment;
upon a third or subsequent conviction, such person shall be punished by imprisonment
for not more than 90 days, or by both such fine and imprisonment.
This law shall take effect immediately upon filing with the Secretary
of State, State of New York, pursuant to § 27 of the Municipal Home
Rule Law.
