No person shall operate an amusement, including but not limited to an amusement park, a carousel, merry-go-round, Ferris wheel, steeplechase, scenic cave, shooting gallery, skating rink, miniature golf course, striking machine, ring toss, menagerie or similar amusement, nor shall any person operate or conduct a circus, rodeo, carnival, fair, bazaar, theater, moving picture or other public exhibition nor a parade or procession unless such person shall have obtained previously a special license therefor, for which the fee shall be as hereinafter specified.

Application for a special license shall be made in writing to the Village Clerk, setting forth the date or dates, location and character of the activity or event and the names and addresses of the owners, operators and conductors thereof. The special license may be issued by the Village Clerk upon the approval of the Mayor.

The fees for the special licenses provided for in this article shall be as follows:
A. 
Amusements: $50 each day.
B. 
Circus, rodeo, carnival: $500 each day.
C. 
Fair or bazaar: $25 each day.

The fee requirements of this article shall not apply to any activity or event such as is described in this article the proceeds of which are exclusively for the benefit of a charitable, benevolent or religious organization.
This article may be suspended in the discretion of the Board of Trustees under such conditions and restrictions as it may impose, provided that an application, in writing, for such suspension is made to the Board of Trustees at least 14 days prior to an activity or event as described in this article.

Any license issued hereunder shall run for a specified period following the date thereof unless sooner revoked. Any license issued pursuant to this article may be revoked by the licensing officer or by the Board of Trustees, after due notice to the person affected by such revocation and an opportunity afforded him to be heard, for any of the following reasons:
A. 
Fraud or misrepresentation in the application for the license;
B. 
Conviction of the licensee of any crime;
C. 
Conducting or engaging in the licensed trade or occupation in an unlawful manner or in a manner which disturbs or is likely to disturb the peace and order of the Incorporated Village of Port Jefferson; or
D. 
Any assignment or transfer of the license to another person.

Any person who violates this article or fails to comply with any of its requirements shall, upon conviction thereof, be subject to the penalties provided in § 1-2 of the Code of the Village of Port Jefferson.
