A.
The purpose of this chapter is to provide the Village
of Port Jefferson with rules and regulations to improve public safety
by promoting the control of fire hazards; regulating the installation,
use and maintenance of equipment; regulating the use of structures,
premises and open areas; providing for the abatement of fire hazards;
and setting forth standards for compliance and achievement of these
objectives.
B.
It is the intent of this chapter to identify, adopt
and use specific standards and codes relating to the prevention of
fires published by the National Fire Protection Association.
A.
This chapter adopts the Fire Prevention Code of the
National Fire Protection Association (NFPA) and its incorporated standards
and codes as published in the National Codes of the National Fire
Protection Association, being particularly the annual edition thereof,
save and except those portions such as may hereinafter be deleted,
modified or amended within this chapter. The same are hereby adopted
and incorporated as fully as if set forth at length herein.
B.
Not less than one full set of the adopted issue of
the Fire Prevention Code of the National Fire Protection Association
and the adopted standards and codes shall be filed in the office of
the Village Clerk, and the provisions thereof shall be controlling
within the Incorporated Village of Port Jefferson.
The provisions of this chapter shall apply to
all buildings, structures, marine vessels and premises which shall
be constructed or erected and to conditions which arise in the Incorporated
Village of Port Jefferson after the effective date hereof. The provisions
of this chapter shall also apply to existing buildings, structures,
vessels, premises or conditions in the Incorporated Village of Port
Jefferson when, in the opinion of the Fire Marshal, they constitute
a distinct fire hazard to life or the property of others.
The provisions of this chapter, as far as they
are substantially the same as existing provisions of law relating
to the same subject matter, shall be construed as restatements and
continuations thereof and not as new enactments.
This chapter is intended to be used in conjunction
with existing laws, and nothing in this chapter shall be construed
as rendering other applicable laws invalid. Where no law exists, or
where existing laws are silent in any area where this chapter sets
forth specific provisions, the provisions of this chapter shall apply.
In a situation where a conflict exists between a provision of this
chapter and any existing law, the more stringent law shall prevail.
If any subsequent change or addition to the National Fire Protection
Association Code results in a less stringent interpretation of a regulation
than a previous regulation, then the more stringent regulation will
prevail.
If any provision of this chapter is for any
reason held to be invalid or unconstitutional by a court of competent
jurisdiction, it shall not affect the validity of the remaining provisions
of this chapter.
This chapter shall take effect immediately upon
filing in the office of the Secretary of State.
