[HISTORY: Adopted by the Board of Trustees of the Village of Port Jefferson as Ch. 60 of the 1970 Code. Amendments noted where applicable.]
GENERAL REFERENCES
Subdivision of land — See Ch. 220.
Trees, grading and land clearing — See Ch. 241.
No person shall excavate sand, gravel, stone or other minerals or strip topsoil from any lands within the Village unless such person shall have obtained a special license therefor. Said license may be issued by the Village Clerk upon the written authority of the Board of Trustees and after payment of such fee as may be prescribed by the Board of Trustees in their discretion and subject to such conditions and restrictions as may be imposed by the Board of Trustees in their discretion.
This chapter shall not apply to excavations or stripping where the same is incidental to the erection of any building or where the same is for the purpose of grading said lands with reference to adjoining property or streets.

Any person who violates this chapter or fails to comply with any of its requirements shall, upon conviction thereof, be subject to the penalties provided in § 1-2 of the Code of the Village of Port Jefferson.
