There is hereby created the position of Parking Violations Officer. Notwithstanding any provision of the Uniform District Court Act and/or the Uniform Justice Court Act, the Parking Violations Officer shall have the power to issue and serve, within the Village of Port Jefferson, appearance tickets and/or subpoenas for violation of the Vehicle and Traffic Code in cases involving nonmoving violations. Such service shall have the same force and effect as if served by a peace officer without his being a peace officer.
A.ย 
To strengthen the authority of the Code Enforcement Bureau, there is hereby specifically enacted to the Village Code the following sections of the New York State Vehicle and Traffic Law by reference:
(1)ย 
Sections 1100 to 1196, inclusive.
(2)ย 
Sections 1200 to 1253, excluding ยงยงย 1204, 1223, 1229, 1228-a and 1229-b.
(3)ย 
There is hereby incorporated by reference all the sections of the New York State Vehicle and Traffic Law not previously incorporated into the Village Code, capable of being enforced by Village personnel, and not specifically excluded from being enacted into local municipal laws.
B.ย 
Except as indicated below, a violation of Subsection A(2) of this section shall be punishable by a minimum fine of $50. For the following violations, the minimum fine for a first conviction shall be as follows:

(1)ย 
Fire hydrant/lane [Vehicle and Traffic Law ยงย 1202(b)]: $200.
(2)ย 
Handicapped parking (Vehicle and Traffic Law ยงยงย 1203-a, 1203-b and 1203-c): $200 plus any surcharge imposed by the State of New York.

A.ย 
Except as indicated below, every person convicted of a traffic infraction for a violation of any provision of this chapter which is not a violation of any provision of the Vehicle and Traffic Law of the State of New York shall, for a first conviction thereof, be punished by a fine of not more than $50 or by imprisonment for not more than 15 days, or by both such fine and imprisonment; for a second such conviction within 18 months thereafter, such person shall be punished by a fine of not more than $100 or by imprisonment for not more than 45 days, or by both such fine and imprisonment; upon a third or subsequent conviction within 18 months after the first conviction, such person shall be punished by a fine of not more than $250 or by imprisonment for not more than 90 days, or by both such fine and imprisonment. For the following violations, the minimum fine for a first conviction shall be as follows:

All fines on all penalties authorized under Village Code Chapter 245 shall increase as follows:
(1)ย 
At 30 days from issuance, fine is doubled.
(2)ย 
At 60 days from issuance, fine is tripled from original amount.
(3)ย 
At 90 days from issuance, $20 is added to the maximum fine.
A.ย 
Except those parts, if any, which are subject to approval under ยงย 1684 of the Vehicle and Traffic Law of the State of New York, this chapter and any regulations adopted hereunder shall take effect as provided by law.
B.ย 
Any part or parts of this chapter and any regulations adopted hereunder which are subject to approval under ยงย 1684 of the Vehicle and Traffic Law of the State of New York shall take effect from and after the day on which approval in writing is received from the New York State Department of Transportation.
If any article, section, subsection, paragraph, sentence, clause or provision of this chapter shall be adjudged by any court of competent jurisdiction to be invalid, such adjudication shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the article, section, subsection, paragraph, sentence, clause or provision thereof directly involved in the controversy in which such judgment shall have been rendered.
All prior ordinances, regulations and rules, or parts thereof, of this Village regulating traffic and parking are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance, regulation or rule hereby repealed prior to the taking effect of this chapter.
