It shall be unlawful for any person, firm or corporation to occupy or
use any new or existing building, structure or portion thereof or any land
without first obtaining a certificate of use from the Code Enforcement Officer.
A.
No change of use, occupancy, tenancy or ownership shall
be made in any existing building, structure or portion thereof or any land
without first obtaining a certificate of use from the Code Enforcement Officer.
B.
In the case of property transfer, reoccupation of vacant
property or new leasing of a property, the Code Enforcement Officer shall
require from each owner or their authorized agent a new certificate of use.
C.
A certificate of use is not required for the refinancing
of an existing building, structure or land.
A.
No certificate of use permit shall be issued until the
Code Enforcement Officer has confirmed that the proposed use complies with
the provisions of this code and all other ordinances, regulations and codes
of the Township of Springfield.
B.
In addition to determining compliance with this code
and all other ordinances, regulations and codes of the Township of Springfield,
the Board of Commissioners shall establish, by resolution, minimum life safety
inspection requirements for all building and structures.
C.
A temporary certificate of use permit may be issued by
the Code Enforcement Officer for a period he or she deems reasonable contingent
upon the following:
A fee shall accompany each certificate of use application filed. The fee for each application shall be established by the Board of Commissioners in accordance with Chapter 40 of the Code of the Township of Springfield.
Any person, persons, firm or corporation who shall violate a provision of Chapter 26, Certificate of Use, or who shall fail to comply with any of the requirements thereof or a directive of the Township of Springfield's Code Enforcement Officer or his deputy relating thereto shall, upon judgment against any person, persons, firm or corporation, be subject to the provisions of Chapter 1, Article II, entitled "Penalties," § 1-10, entitled "Violations and penalties," Subsection A thereof.
