It is hereby declared unlawful for any person to dump or place or deposit any loose papers, rubbish, refuse, garbage, bulk waste, building rubbish or hazardous waste, as defined in Article I of Chapter 54, in, along or upon any public highway of this Township. The placement of items intended for recycling, bulk waste or refuse collection, when placed in accordance with current precollection and collection practices as set out in Article I of Chapter 54, are excluded, but in no event shall any deposit of said defined items be placed beyond the curbline and into the cartway or gutter.
It shall be unlawful and shall constitute a public nuisance for any person owning or occupying private property in Springfield Township to deposit or to cause or permit the deposit, maintenance, growth or existence of rubbish, noxious vegetation or other objectionable accumulations on any property so owned or occupied.
It shall be unlawful for any person to deposit or cause to be deposited any refuse, rubbish, solid waste, garbage, building rubbish or hazardous waste, as defined in Article I of Chapter 54, on or upon any private property or cause to drain any liquid waste or solid waste into any stream or storm drain or any body of water in the Township. Discharge water from a private swimming pool is excluded when controlled, as provided in Chapter 126, Swimming Pools, of the Code.
In the case of any violation of §§ 54-7 and 54-8 of this ordinance, in addition to other remedies provided by law, the Health Officer acting for the Township may, after five days' notice or, in urgent cases, without such notice, enter upon or in all such premises with his workmen, contractors or agents and abate such nuisances, as often as the particular circumstances warrant, to ensure the health and safety of the Township.
Whenever and as often as it becomes necessary for the Health Officer to take action under this ordinance, the expense thereof, with 20% additional, together with all incidental costs, fees, charges and expenses, may be collected by action in assumpsit or otherwise, from the owner or occupier, either or both at the option of the Township. The Township may also, as an additional remedy, cause a municipal lien or claim to be filed against said property, or as much thereof with the appurtenances as is involved in the violation aforesaid.
Any notice referred to in this ordinance may be served upon the tenant or occupier of the premises or any part thereof or may be given by posting a written or printed notice upon some public part of the premises or by mailing the same to the last known address of the owner or occupier of such premises, at the option of the Township.
It shall hereafter be unlawful for any property owner to use any private property in this Township for the purpose of a public dump or to permit the same to be used by others for dumping purposes, unless and until such property owner shall have obtained and shall hold a permit from the Township Commissioners for so doing.
