The sale of cigarettes from vending machines situated within one thousand
(1,000) feet of any public or private elementary, middle or high school is
hereby prohibited. This prohibition shall not apply to private clubs not open
to the general public.
Any person owning, operating, renting or permitting the use of a cigarette
vending machine on premises under his or her control shall be subject to a
fine of five hundred dollars ($500.). Each day that the violation occurs shall
constitute a separate violation.
