A.
The Town Board of the Town of Bethel hereby finds
that the leaving of vehicles on Town highways during periods of snowfall
has hindered and obstructed the Superintendent of Highways in snow
removal operations. The Town Board further finds that the leaving
of vehicles on highways within the Town during snowstorms causes hazards
to persons using such highways.
B.
The purpose of this chapter is to protect the health,
safety and well-being of persons and property by imposing restrictions
on the leaving of vehicles on highways during snowstorms.
A.
TOWN
As used in this chapter, the following terms shall
have the meanings indicated:
The Town of Bethel.
B.
Other definitions. The words and phrases used in this
chapter shall, for the purposes of this chapter, have the meanings
respectively ascribed to them by Article 1 of the Vehicle and Traffic
Law of the State of New York.
The parking of vehicles is hereby prohibited
on all highways within the Town of Bethel from December 1 of each
year to May 1 of the following year during the hours commencing at
10:00 p.m. and ending at 10:00 a.m.
Any vehicle left abandoned or permitted to remain
parked unattended, in violation of the provisions of this chapter,
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic. The Superintendent of Highways, his agents, servants or
employees and/or any police officer may remove or cause to be removed
any such vehicle to any location without any liability for damage
to said vehicle. The owner or person in charge of said vehicle shall
be required to reimburse the Town for the actual necessary costs of
removal and storage thereof before such vehicle shall be returned.
Reimbursement shall be in addition to any penalty for a violation
of this chapter as set forth herein.
It shall be the duty of the Superintendent of
Highways and/or any police officer, as the case may be, to ascertain
to the extent possible the owner of the vehicle or person having charge
of the same and to notify such person of the removal and disposition
of such vehicle as provided in this chapter and the amount which will
be required to redeem the same.

In addition to any penalty contained in any
other provision of law, any person who shall violate any provision
of this chapter shall be guilty of a violation and shall be punished
by a fine not to exceed $250 or imprisonment for a term not to exceed
15 days, or both.
The Highway Superintendent shall maintain appropriate
signs at such places and for such periods as he, in his sole discretion,
shall deem appropriate, advising the public in general and the residents
of the Town of Bethel in particular that there shall be no parking
on any streets or highways within the Town of Bethel during the period
commencing December 1 of each year and ending on May 1 of the following
year, during the hours of 10:00 p.m. to 10:00 a.m.
