No person shall at any time construct, raise or lower any curb located on any street or highway or any other public place within the City without having previously secured a permit to do so. (See § 238-76 for violation and penalty hereof.)

Any person desiring a permit required by § 238-29 shall file with the Director of Public Works of the City an application therefor, signed by the owner of the premises affected, upon which shall be stated the name and address of the owner, a description of the premises sufficient to identify the same and specifications or plans showing, as nearly as possible, the exact point where it is desired that the curb shall be constructed, raised or lowered.

All permits under this article shall be issued by the Director of Public Works, who is hereby authorized to charge a nonrefundable permit fee of $0.50 for each linear foot of curb to be constructed, raised or lowered for the issuance of the same.

The constructing, raising or lowering of curbs shall be performed in accordance with regulations to be prescribed by the Director of Public Works.
Upon the filing of any application for a permit under this article, the applicant shall deposit with the Collector of Taxes the sum of $10 for each linear foot of curb to be constructed, raised or lowered, provided that no permit shall be issued upon a deposit of less than $20.

Upon the certificate of the Director of Public Works that the work of constructing, raising or lowering the curb as aforesaid has been performed in a satisfactory manner and in accordance with the regulations adopted by the Director of Public Works and this chapter and other ordinances of the City, the Collector of Taxes shall return the amount of the deposit to the applicant upon demand. In the case where the party to whom the permit has been granted fails to perform the work in the manner as stated above, the Director of Public Works may perform or cause to be performed such work as may be necessary to make the same satisfactory and in accordance with the regulation as aforesaid, and the cost thereof shall be charged against the deposit, and the balance, if any, shall be returned to the applicant upon demand.
