All deputies and employees of the Sheriff of Rockland County, except the Undersheriff, are hereby placed in the classified service of civil service and shall be employed in accordance with the provisions of the Civil Service Law of the State of New York and shall be subject to and governed by such law and the Rockland County Civil Service Rules and Appendices.

All such deputies and employees of the Sheriff of Rockland County who have served on a permanent basis for one year in duly established positions immediately preceding the date on which this chapter becomes effective shall continue to hold such positions on a permanent basis, without examination and shall have all the rights and privileges of the civil service jurisdictional classification to which such positions may be allocated, and such other deputies and employees who have been duly employed by the Sheriff on the basis of half-time or greater for at least one year preceding the effective date of this chapter shall be deemed to occupy positions as of such date and to have permanent civil service status therein in the title(s) as classified, without examination, and shall have all the rights and privileges of the civil service jurisdictional classification to which such position may be allocated; provided, however, that all such employees employed for less than one year in their respective positions immediately preceding the effective date of this chapter shall be deemed qualified for provisional or noncompetitive class appointment as may be appropriate to their position and shall be further deemed qualified to participate in the next scheduled open competitive examination to be given for such position if then still employed in the Office of the Sheriff; provided, further, however, that on or after such effective date all new positions created and vacancies occurring in existing positions shall be filled in accordance with the Civil Service Law of the State of New York and the Rockland County Civil Service Rules and Appendices.
Except where inconsistent with this chapter, the Sheriff shall have and exercise all the powers and duties now and hereafter conferred or imposed by any law applicable to the Sheriff and such other duties as may be imposed by law.
Any act or omission of any employee of the County in the Office of the Sheriff done or made in the performance of an official duty or for the performance of which the County is paid or receives compensation or fee shall be the act or omission of the County, and the damages, if any, resulting therefrom shall be deemed the liability of the County of Rockland.
Nothing contained in this chapter shall make the County responsible for the acts of the Sheriff thereof nor relieve said Sheriff from any liability to which he is lawfully subject.
Nothing herein contained in this chapter shall apply to or otherwise affect the status of those employees of the Sheriff who are in the classified service as of the effective date of this chapter. The status of such employees shall continue for all purposes as if this chapter had not been adopted.
